                     Whereas the Honourable James J. Carthy, a Judge of the Court of Appeal for Ontario, who has continued in judicial office for at least fifteen years, has tendered his resignation effective  

September 1, 2004, and as of that date his combined age and number of years in judicial office is not less than eighty;

                     Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, hereby

(a) accepts the resignation of the Honourable James J. Carthy; and

(b) pursuant to paragraph 42(1)(a) of the Judges Act, grants him an annuity of $146,266.66 commencing on September 1, 2004, and continuing during his life.

                     Attendu que l’honorable James J. Carthy, juge de la Cour d’appel de l’Ontario, après avoir exercé des fonctions judiciaires pendant au moins quinze ans, a donné sa démission, laquelle prend effet le  

1^er septembre 2004, et que, à cette date, le chiffre obtenu par l’addition de son âge et du nombre d’années d’exercice est d’au moins quatre-vingts,

                     À ces causes, sur recommandation du ministre de la Justice, Son Excellence la Gouverneure générale en conseil :

a) accepte la démission de l’honorable James J. Carthy;

b) en vertu de l’alinéa 42(1)a) de la Loi sur les juges, accorde à l’honorable James J. Carthy, à titre viager, une pension annuelle  

de 146 266,66 $, à compter du 1^er septembre 2004.
