Whereas Her Majesty in right of the Province of Manitoba (“Manitoba”) is empowered by The Highways and Transportation Act, C.C.S.M., c. H40, to take lands or an interest therein without the consent of the owner for public highways and purposes connected with public highways;
Whereas Manitoba requires the entire interest of Her Majesty in right of Canada (“Canada”) in certain lands in Cross Lake Indian Reserve No. 19B described in Schedule I (the “Lands”), excepting mines and minerals, for the purposes of the realignment of a highway and the construction of a bridge;
And whereas it is proposed that the Governor in Council consent to the exercise by Manitoba of that power in relation to the Lands and, in lieu of Manitoba taking the Lands without the consent of the owner, authorize the transfer to Manitoba of the administration and control of the entire interest of Canada in the Lands, excepting mines and minerals;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, hereby:
(a) pursuant to subsection 35(1) of the Indian Act, consents to the exercise by Manitoba of the power to take the Lands described in Schedule I without the consent of the owner, subject to the terms set out in paragraph (b); and
(b) pursuant to subsection 35(3) of the Indian Act, in lieu of Manitoba taking the Lands, authorizes the transfer of the administration and control of the Lands to Manitoba for as long as the Lands are used for a public highway and bridge and subject to the terms and conditions of the Memorandum of Understanding between Manitoba and Canada dated May 14, 2004 set out in Schedule II.
Attendu que, en vertu de la Loi sur la voirie et le transport, C.P.L.M., ch. H40, Sa Majesté du chef de la province du Manitoba (le « Manitoba ») a le pouvoir de prendre des terres ou tout droit sur celles-ci, sans le consentement du propriétaire, aux fins d’utilisation comme voie publique et à des fins connexes;
Attendu que le Manitoba a besoin du droit intégral de Sa Majesté du chef du Canada (le « Canada ») sur certaines terres de la réserve indienne de Cross Lake no 19B décrites à l’annexe I (les « terres »), à l’exclusion des mines et des minéraux, en vue du nouvel alignement d’une route et de la construction d’un pont;
a) en vertu du paragraphe 35(1) de la Loi sur les Indiens, consent à ce que le Manitoba exerce son pouvoir de prendre les terres décrites à l’annexe I, sans le consentement du propriétaire, sous réserve de l’alinéa b);
