                     Whereas, pursuant to subsection 41(1) of the Public Service Employment Act, the Public Service Commission has decided that it is neither practicable nor in the best interests of the Public Service to apply certain provisions of that Act to a certain person and to certain positions in Health Canada, and has, on May 18, 2004, excluded from the operation of section 12 of that Act, the positions in the Scientific Regulation Group in Health Canada and the employee referred to in the schedule who may be appointed to such positions;

                     Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to subsection 41(1) of the Public Service Employment Act, hereby approves the exclusion made on May 18, 2004 by the Public Service Commission from the operation of section 12 of that Act, of the positions in the Scientific Regulation Group in Health Canada and of the employee referred to in the schedule who may be appointed to such positions.

                     Attendu que, conformément au paragraphe 41(1) de la Loi sur l’emploi dans la fonction publique, la Commission de la fonction publique estime qu’il est difficilement réalisable et contraire aux intérêts de la fonction publique d’appliquer certaines dispositions de cette loi à une certaine personne et à certains postes de Santé Canada, et a, le 18 mai 2004, exempté de l’application de l’article 12 de cette loi les postes du groupe Réglementation scientifique de Santé Canada et le fonctionnaire qui pourrait être nommé à de tels postes et dont le nom apparaît en annexe,

                     À ces causes, sur recommandation de la ministre du Patrimoine canadien et en vertu du paragraphe 41(1) de la Loi sur l’emploi dans la fonction publique, Son Excellence la Gouverneure générale en conseil approuve l’exemption de l’application de l’article 12 de cette loi accordée par la Commission de la fonction publique le 18 mai 2004 aux postes du groupe Réglementation scientifique de Santé Canada et au fonctionnaire qui pourrait être nommé à de tels postes et dont le nom apparaît en annexe.
