                Attendu que, conformément au paragraphe 41(1) de la Loi sur l'emploi dans la fonction publique, la Commission de la fonction publique estime qu'il est difficilement réalisable et contraire aux intérêts de la fonction publique d'appliquer certaines dispositions de cette loi à certaines personnes et à un certain poste de la Commission de la fonction publique, et a, le 13 novembre 2003, exempté de l'application des articles 10 et 12 et des paragraphes 21(1.1), 29(3), 30(1) et (2), et 39(3) et (4) de cette loi, ainsi que de l'application des règlements pris en vertu de l'alinéa 35(2)a) de celle-ci, certaines personnes qui autrement auraient un droit d'appel et le poste de la Commission de la fonction publique identifié en annexe auquel sera nommée la fonctionnaire dont le nom apparaît à cette même annexe,

                À ces causes, sur recommandation de la ministre du Patrimoine canadien et en vertu du paragraphe 41(1) de la Loi sur l'emploi dans la fonction publique, Son Excellence la Gouverneure générale en conseil approuve l'exemption de l'application des articles 10 et 12 et des paragraphes 21(1.1), 29(3), 30(1) et (2), et 39(3) et (4) de cette loi, ainsi que de l'application des règlements pris en vertu de l'alinéa 35(2)a) de celle-ci, accordée par la Commission de la fonction publique le 13 novembre 2003 à certaines personnes qui autrement auraient un droit d'appel et au poste de la Commission de la fonction publique identifié en annexe auquel sera nommée la fonctionnaire dont le nom apparaît à cette même annexe.

                Whereas, pursuant to subsection 41(1) of the Public Service Employment Act, the Public Service Commission has decided that it is neither practicable nor in the best interests of the Public Service to apply certain provisions of that Act to certain persons and to a certain position in the Public Service Commission, and has, on November 13, 2003, excluded from the operation of sections 10 and 12 and subsections 21(1.1), 29(3), 30(1) and (2) and 39(3) and (4) of that Act and from the operation of any regulations made under paragraph 35(2)(a) of that Act, certain persons who would otherwise have a right to appeal and the position in the Public Service Commission to which the employee referred to in the annexed schedule will be appointed;

                Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to subsection 41(1) of the Public Service Employment Act, hereby approves the exclusion made on November 13, 2003 by the Public Service Commission from the operation of sections 10 and 12 and subsections 21(1.1), 29(3), 30(1) and (2) and 39(3) and (4) of that Act and from the operation of any regulations made under paragraph 35(2)(a) of that Act, of certain persons who would otherwise have a right to appeal and of the position in the Public Service Commission listed in the schedule to which the employee referred to in that schedule will be appointed.
