Whereas, under subsection 332(1) of the Canadian Environmental Protection Act, 1999, the Minister of the Environment published in the Canada Gazette, Part I, on December 16, 2023, a copy of the proposed Regulations Amending the Regulations Respecting Reduction in the Release of Methane and Certain Volatile Organic Compounds (Upstream Oil and Gas Sector) and persons were given an opportunity to file comments with respect to the proposed Regulations or to file a notice of objection requesting that a board of review be established and stating the reasons for the objection;

Whereas, under subsection 93(3) of that Act, the National Advisory Committee has been given an opportunity to provide its advice under section 6 of that Act;

And whereas, in the opinion of the Governor in Council, under subsection 93(4) of that Act, the proposed Regulations do not regulate an aspect of a substance that is regulated by or under any other Act of Parliament in a manner that provides, in the opinion of the Governor in Council, sufficient protection to the environment and human health;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment and the Minister of Health, makes the annexed Regulations Amending the Regulations Respecting Reduction in the Release of Methane and Certain Volatile Organic Compounds (Upstream Oil and Gas Sector) under subsection 93(1), section 286.1 and subsection 330(3.2) of the Canadian Environmental Protection Act, 1999.

Attendu que, conformément au paragraphe 332(1) de la Loi canadienne sur la protection de l’environnement (1999), le ministre de l’Environnement a fait publier dans la Partie I de la Gazette du Canada, le 16 décembre 2023, le projet de règlement intitulé Règlement modifiant le Règlement sur la réduction des rejets de méthane et de certains composés organiques volatils (secteur du pétrole et du gaz en amont) et que les intéressés ont ainsi eu la possibilité de présenter leurs observations à cet égard ou un avis d’opposition motivé demandant la constitution d’une commission de révision;

Attendu que, conformément au paragraphe 93(3) de cette loi, le comité consultatif national s’est vu donner la possibilité de formuler ses conseils au titre de l’article 6 de la même loi;

Attendu que la gouverneure en conseil est d’avis que, aux termes du paragraphe 93(4) de cette loi, le projet de règlement ne vise pas un point déjà réglementé sous le régime d’une autre loi fédérale de manière à offrir une protection suffisante pour l’environnement et la santé humaine,

À ces causes, sur recommandation de la ministre de l’Environnement et de la ministre de la Santé et en vertu du paragraphe 93(1), de l’article 286.1 et du paragraphe 330(3.2) de la Loi canadienne sur la protection de l’environnement (1999), Son Excellence la Gouverneure générale en conseil prend le Règlement modifiant le Règlement sur la réduction des rejets de méthane et de certains composés organiques volatils (secteur du pétrole et du gaz en amont), ci‑après.
