Her Excellency the Governor General in Council, on the recommendation of the Minister of Finance and the Minister of Foreign Affairs, makes the annexed Order Amending the Order Imposing a Surtax on the Importation of Certain Steel Goods under subsection 53(2) and section 79 of the Customs Tariff.

Order Amending the Order Imposing a Surtax on the Importation of Certain Steel Goods
Amendments
1(1) The portion of subsection 2(1) of the Order Imposing a Surtax on the Importation of Certain Steel Goods1 before paragraph (a) is replaced by the following:
Surtax — countries with no trade agreement
2(1) Subject to section 3, goods that are classified under a tariff item set out in column 4 of Schedule 1 and do not originate in a country listed in Schedule 3, as well as those that are otherwise classifiable under one of those tariff items but are classified under a tariff item of Chapter 99 of the List of Tariff Provisions, are subject to a surtax in the amount of 50% of their value for duty determined in accordance with sections 47 to 55 of the Customs Act if
(2) Section 2 of the Order is amended by adding the following after subsection (1):
Transitional measures
(1.1) For the period beginning on August 1, 2025 and ending on September 25, 2025, the surtax referred to in subsection (1) applies if
(a) the quantity of goods of the same class imported during that period exceeds the quantity determined by the formula
A - B
where
A is the quarterly total set out in column 2 of Schedule 1 for goods of the same class, and
B is the quantity of goods of the same class that are imported during the period beginning on June 27, 2025 and ending on July 31, 2025 under a permit that is issued under subsection 8(1) of the Export and Import Permits Act in respect of steel goods referred to in item 82 of the Import Control List; or
(b) the quantity of goods of the same class that originate in the same country and are imported during the period beginning on June 27, 2025 and ending on September 25, 2025 under a permit that is issued under subsection 8(1) of the Export and Import Permits Act in respect of steel goods referred to in item 82 of the Import Control List exceeds the quantity determined by multiplying the percentage set out in column 3 of Schedule 1 by the quarterly total set out in column 2 of that Schedule for that class.
(3) Subsection 2(3) of the Order is repealed.
2 The Order is amended by adding the following after section 2:
Surtax — countries with trade agreement
2.1(1) Subject to section 3, goods that are classified under a tariff item set out in column 4 of Schedule 2 and originate in a country listed in Schedule 3, as well as those that are otherwise classifiable under one of those tariff items but are classified under a tariff item of Chapter 99 of the List of Tariff Provisions, are subject to a surtax in the amount of 50% of their value for duty determined in accordance with sections 47 to 55 of the Customs Act if
(a) the quantity of goods of the same class that are imported during the same quarterly period exceeds the quarterly total set out in column 2 of Schedule 2 for that class; or
(b) the quantity of goods of the same class that originate in the same country and are imported during the same quarterly period exceeds the quantity determined by multiplying the percentage set out in column 3 of Schedule 2 by the quarterly total set out in column 2 of that Schedule for that class.
Transitional measures
(2) For the period beginning on August 1, 2025 and ending on September 25, 2025, the surtax referred to in subsection (1) applies if
(a) the quantity of goods of the same class imported during that period exceeds the total set out in column 2.1 of Schedule 2 for that class; or
(b) the quantity of goods of the same class that originate in the same country and are imported during that period exceeds the quantity determined by multiplying the percentage set out in column 3 of Schedule 2 by the total set out in column 2.1 of that Schedule for that class.
Quarterly period
(3) For the purposes of subsection (1), a quarterly period is a three-month period, the first of which begins on September 26, 2025.
Import permit
(4) Goods are considered to be imported in excess of the limits set out in subsection (1) if they are not imported under a permit that is issued under subsection 8(1) of the Export and Import Permits Act in respect of steel goods referred to in item 82 of the Import Control List and that is valid at the time at which the goods are accounted for under subsection 32(1), (3) or (5) of the Customs Act.
3(1) Paragraphs 3(a) and (b) of the Order are replaced by the following:
(a) goods referred to in subsections 2(1) and (1.1) that are in transit to Canada on or before June 27, 2025;
(a.1) goods referred to in subsections 2.1(1) and (2) that are in transit to Canada on or before August 1, 2025;
(b) goods originating in Canada, the United States or Mexico;
(2) Paragraph 3(d) of the Order is replaced by the following:
(d) goods that are classified under a tariff item of Chapter 98 of the List of Tariff Provisions, even if the goods are otherwise classifiable under a tariff item set out in column 4 of Schedule 1 or in column 4 of Schedule 2.
4 The Order is amended by adding the following after section 3:
Other surtaxes
3.1 Despite any other order made under the Customs Tariff, if a good that is subject to a surtax under this Order is also subject to any other surtax under the Customs Tariff, only the surtax under this Order is applicable to the good.
5 Schedules 1 and 2 to the Order are replaced by the Schedules 1, 2 and 3 set out in the schedule to this Order.
Coming into Force
6 This Order comes into force on August 1, 2025.

Décret modifiant le Décret imposant une surtaxe sur l’importation de certains produits de l’acier
Modifications
1(1) Le passage du paragraphe 2(1) du Décret imposant une surtaxe sur l’importation de certains produits de l’acier1 précédant l’alinéa a) est remplacé par ce qui suit :
Surtaxe — pays sans accord commercial
2(1) Sous réserve de l’article 3, les marchandises classées dans l’un des numéros tarifaires visés à la colonne 4 de l’annexe 1 qui ne sont pas originaires d’un pays visé à l’annexe 3 — ainsi que celles qui peuvent également être classées dans l’un de ces numéros tarifaires, mais qui sont classées dans un numéro tarifaire du Chapitre 99 de la liste des dispositions tarifaires — sont assujetties à une surtaxe correspondant à cinquante pour cent de leur valeur en douane, déterminée conformément aux articles 47 à 55 de la Loi sur les douanes, si, selon le cas :
(2) L’article 2 du même décret est modifié par adjonction, après le paragraphe (1), de ce qui suit :
Mesures transitoires
(1.1) Pour la période débutant le 1er août 2025 et se terminant le 25 septembre 2025, la surtaxe prévue au paragraphe (1) s’applique dans les cas suivants :
a) la quantité de marchandises de la même catégorie qui sont importées au cours de cette période est supérieure à la quantité obtenue par la formule suivante :

A représente le total trimestriel prévu à la colonne 2 de l’annexe 1 pour la même catégorie de marchandises,
B la quantité de marchandises de la même catégorie qui sont importées — au cours de la période débutant le 27 juin 2025 et se terminant le 31 juillet 2025 — conformément à une licence délivrée en vertu du paragraphe 8(1) de la Loi sur les licences d’exportation et d’importation à l’égard de produits en acier figurant à l’article 82 de la Liste des marchandises d’importation contrôlée;
b) la quantité de marchandises de la même catégorie qui sont originaires du même pays et qui sont importées — au cours de la période débutant le 27 juin 2025 et se terminant le 25 septembre 2025 — conformément à une licence délivrée en vertu du paragraphe 8(1) de la Loi sur les licences d’exportation et d’importation à l’égard de produits en acier figurant à l’article 82 de la Liste des marchandises d’importation contrôlée est supérieure à la quantité obtenue par la multiplication du pourcentage prévu à la colonne 3 de l’annexe 1 par le total trimestriel prévu à la colonne 2 de cette annexe pour la catégorie.
(3) Le paragraphe 2(3) du même décret est abrogé.
2 Le même décret est modifié par adjonction, après l’article 2, de ce qui suit :

2.1(1) Sous réserve de l’article 3, les marchandises classées dans l’un des numéros tarifaires visés à la colonne 4 de l’annexe 2 qui sont originaires d’un pays visé à l’annexe 3 — ainsi que celles qui peuvent également être classées dans l’un de ces numéros tarifaires, mais qui sont classées dans un numéro tarifaire du Chapitre 99 de la liste des dispositions tarifaires — sont assujetties à une surtaxe correspondant à cinquante pour cent de leur valeur en douane, déterminée conformément aux articles 47 à 55 de la Loi sur les douanes, si, selon le cas :
a) la quantité de marchandises de la même catégorie qui sont importées au cours du même trimestre est supérieure au total trimestriel prévu à la colonne 2 de l’annexe 2 pour la catégorie;
b) la quantité de marchandises de la même catégorie qui sont originaires du même pays et qui sont importées au cours du même trimestre est supérieure à la quantité obtenue par la multiplication du pourcentage prévu à la colonne 3 de l’annexe 2 par le total trimestriel prévu à la colonne 2 de cette annexe pour la catégorie.
Mesures transitoires
(2) Pour la période débutant le 1er août 2025 et se terminant le 25 septembre 2025, la surtaxe prévue au paragraphe (1) s’applique dans les cas suivants :
a) la quantité de marchandises de la même catégories qui sont importées au cours de cette période est supérieure au total spécifié à la colonne 2.1 de l’annexe 2 pour la catégorie;
b) la quantité de marchandises d’une catégorie qui sont originaires du même pays et qui sont importées au cours de cette période est supérieure à la quantité obtenue par la multiplication du pourcentage prévu à la colonne 3 de l’annexe 2 par le total prévu à la colonne 2.1 de cette annexe pour la catégorie.
Trimestre
(3) Pour l’application du paragraphe (1), un trimestre est une période de trois mois dont le premier commence le 26 septembre 2025.
Licence d’importation
(4) Les marchandises sont considérées comme étant importées en quantité dépassant les limites prévues au paragraphe (1) si elles ne sont pas importées aux termes d’une licence qui est délivrée en vertu du paragraphe 8(1) de la Loi sur les licences d’exportation et d’importation à l’égard de produits en acier figurant à l’article 82 de la Liste des marchandises d’importation contrôlée et qui est valide au moment où elles font l’objet de la déclaration en détail prévue aux paragraphes 32(1), (3) ou (5) de la Loi sur les douanes.
3(1) Les alinéas 3a) et b) du même décret sont remplacés par ce qui suit :
a) les marchandises visées aux paragraphes 2(1) et (1.1) qui sont en transit vers le Canada le 27 juin 2025 ou avant cette date;
a.1) les marchandises visées aux paragraphes 2.1(1) et (2) qui sont en transit vers le Canada le 1er août 2025 ou avant cette date;
b) les marchandises qui sont originaires du Canada, des États-Unis ou du Mexique;
(2) L’alinéa 3d) du même décret est remplacé par ce qui suit :
d) les marchandises classées dans un numéro tarifaire du Chapitre 98 de la liste des dispositions tarifaires, même si elles peuvent également être classées dans un numéro tarifaire visé à la colonne 4 de l’annexe 1 ou à la colonne 4 de l’annexe 2.
4 Le même décret est modifié par adjonction, après l’article 3, de ce qui suit :
Autres surtaxes
3.1 Si d’autres surtaxes sont établies par tout autre décret pris en vertu du Tarif des douanes à l’égard de toute marchandise visée par le présent décret, seule la surtaxe établie par celui-ci s’applique à l’égard de la marchandise visée.
5 Les annexes 1 et 2 du même décret sont remplacées par les annexes 1, 2 et 3 figurant à l’annexe du présent décret.
Entrée en vigueur
6 Le présent décret entre en vigueur le 1er août 2025.
