Whereas paragraph 4(a) of the Bridges Act provides that no bridge is to be opened for public use until notice in writing of intention to open the bridge has been given to the Minister of Public Works and Government Services (“Minister”) by the company that owns the bridge;
Whereas subsection 5(1) of the Bridges Act provides that the Minister, on receiving a notice under paragraph 4(a) of that Act, must direct an engineer attached to or employed by the Department of Public Works and Government Services to examine the bridge proposed to be opened and report to the Minister, in writing, their opinion as to the completeness and sufficiency of the bridge, with the grounds for that opinion;
Whereas subsection 5(2) of the Bridges Act provides that in cases where the engineer reports that, in their opinion, a bridge would be dangerous to the public using it, the Minister may, with the approval of the Governor in Council, order the company that owns the bridge to postpone the opening of the bridge;
Whereas the Windsor–Detroit Bridge Authority (“Authority”) intends to open an international bridge across the Detroit River between Windsor, Ontario and Detroit, Michigan and to comply with the requirements under the authorization process set out in section 5 of the Bridges Act through a public-private partnership contractual framework as well as with existing reporting obligations under the Financial Administration Act and the International Bridges and Tunnels Act;
Whereas requiring the Authority to comply with the requirements under the authorization process set out in sections 4 and 5 of the Bridges Act with respect to the construction of the international bridge would be redundant, costly, time-consuming and an inefficient use of public resources;

Whereas failure by the Authority to comply with those requirements with respect to the construction of the international bridge across the Detroit River between Windsor, Ontario and Detroit, Michigan, if the Authority is not exempted from the application of those sections, may delay the opening of the international bridge, with impacts on revenue, traffic and international trade;
Whereas subsection 6(1) of the Bridge To Strengthen Trade Act provides that the Governor in Council may, by order, exempt any person, on any condition that the Governor in Council considers to be in the public interest, from any requirement under any federal Act to obtain a permit, licence, approval or other authorization with respect to the construction of a bridge, parkway or any related work;
And whereas, under Order in Council P.C. 2015-1238 of November 4, 2015, the powers, duties and functions under the Bridge To Strengthen Trade Act were transferred from the Minister of Transport to the Minister of Infrastructure, Communities and Intergovernmental Affairs;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Infrastructure and Communities, in accordance with subsection 6(1) of the Bridge To Strengthen Trade Act, exempts the Windsor–Detroit Bridge Authority from the requirements under the authorization process set out in sections 4 and 5 of the Bridges Act with respect to the construction of the international bridge across the Detroit River between Windsor, Ontario and Detroit, Michigan and related works.
Attendu que l’alinéa 4a) de la Loi sur les ponts prévoit qu’un pont ne peut être ouvert pour usage public avant que la compagnie propriétaire ait notifié par écrit au ministre des Travaux publics et des Services gouvernementaux (le ministre) son intention de l’ouvrir;
Attendu que le paragraphe 5(1) de la Loi sur les ponts prévoit que, dès que le ministre reçoit l’avis mentionné à l’alinéa 4a) de cette loi, il ordonne à un ingénieur attaché au ministère des Travaux publics et des Services gouvernementaux, ou employé par ce ministère, d’examiner le pont dont l’ouverture est projetée et de lui donner par écrit son opinion quant à l’état d’achèvement et de suffisance du pont, ainsi que les raisons qui motivent cette opinion;
Attendu que le paragraphe 5(2) de la Loi sur les ponts prévoit que, si l’ingénieur signale qu’il est dangereux, à son avis, de livrer le pont à la circulation publique, le ministre, avec l’assentiment du gouverneur en conseil, peut ordonner à la compagnie propriétaire du pont d’en retarder l’ouverture;
Attendu que l’Autorité du pont Windsor-Détroit (l’Autorité) a l’intention d’ouvrir un pont international sur la rivière Détroit entre Windsor (Ontario) et Detroit (Michigan) et de satisfaire aux exigences du processus d’autorisation prévues à l’article 5 de la Loi sur les ponts au moyen d’un cadre contractuel de partenariat public-privé et des obligations de déclaration prévues par la Loi sur la gestion des finances publiques et de la Loi sur les ponts et tunnels internationaux;
Attendu que le processus visant à assurer la conformité avec les articles 4 et 5 de la Loi sur les ponts pour la construction du pont international serait redondant, coûteux et long et qu’il représenterait une utilisation inefficace des ressources publiques;

Attendu que, si l’Autorité n’est pas exemptée de l’application de ces articles, son défaut de s’y conformer à l’égard de la construction du pont international sur la rivière Détroit entre Windsor (Ontario) et Detroit (Michigan) peut retarder l’ouverture de celui-ci et avoir des répercussions sur les revenus, la circulation et le commerce international;
Attendu que le paragraphe 6(1) de la Loi concernant un pont destiné à favoriser le commerce prévoit que le gouverneur en conseil peut, par décret, exempter toute personne, aux conditions qu’il estime être dans l’intérêt public, de toute obligation qui incombe à celle-ci d’obtenir, au titre de toute loi fédérale, une autorisation, notamment un permis, une licence ou un agrément, à l’égard de la construction d’un pont, d’une promenade ou d’un ouvrage connexe;
