Whereas Pheasant Rump Nakota Indian Reserve No. 68H, in Saskatchewan, is a reserve within the meaning of the Indian Act that has been set apart by His Majesty in right of Canada (“Canada”) for the use and benefit of Pheasant Rump Nakota First Nation (the “First Nation”), a band within the meaning of the Indian Act;
Whereas Saskatchewan Power Corporation (“SaskPower”) — being a corporation that has, under The Power Corporation Act, R.S.S. 1978, c. P-19, the powers referred to in subsection 35(1) of the Indian Act — has requested an easement on certain lands forming part of Pheasant Rump Nakota Indian Reserve No. 68H, which lands are described in the schedule, for the purposes of constructing, operating and maintaining an electrical transmission line (the “permitted purposes”);
Whereas the council of the First Nation has, on behalf of the First Nation, consented to the grant of the easement to SaskPower on the lands described in the schedule for the permitted purposes;
And whereas Canada and SaskPower have negotiated the terms on which the easement is to be held, as evidenced by an agreement, entitled “Specific Claims Replacement Easement Agreement for Electrical Transmission Line Right-Of- Way”;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indigenous Services:
(a) under subsection 35(1) of the Indian Act, consents to the exercise by Saskatchewan Power Corporation (“SaskPower”) of the power to take, in accordance with The Power Corporation Act, R.S.S. 1978, c. P-19, an easement on the lands described in the schedule for the purposes of constructing, operating and maintaining an electrical transmission line (the “permitted purposes”), subject to the terms set out in paragraph (b); and

(b) under subsection 35(3) of the Indian Act, in lieu of SaskPower taking the easement as consented to in paragraph (a), authorizes the grant of an easement on the lands to SaskPower for the permitted purposes, subject to the following terms:
(i) the easement is to be held on terms substantially in accordance with those as set out in “Specific Claims Replacement Easement Agreement for Electrical Transmission Line Right-Of-Way”, and
(ii) the easement will be relinquished when no longer required for the permitted purposes
Attendu que la réserve indienne Pheasant Rump Nakota Indian Reserve No. 68H, en Saskatchewan, est une réserve au sens de la Loi sur les Indiens mise de côté par Sa Majesté du chef du Canada (« Canada ») à l’usage et au profit de la Pheasant Rump Nakota First Nation (la « Première Nation »), bande au sens de la Loi sur les Indiens;
Attendu que la Saskatchewan Power Corporation (« SaskPower ») – une personne morale ayant, en vertu de la loi de la Saskatchewan intitulée The Power Corporation Act, R.S.S. 1978, ch. P-19, les pouvoirs mentionnés au paragraphe 35(1) de la Loi sur les Indiens – a demandé une servitude sur certaines terres faisant partie de la réserve indienne Pheasant Rump Nakota Indian Reserve No. 68H, lesquelles sont décrites à l’annexe, aux fins de la construction, de l’exploitation et de l’entretien d’une ligne de transmission d’électricité (« les fins autorisées »);
Attendu que le conseil de la Première Nation, au nom de la Première Nation, a consenti à l’octroi à SaskPower de la servitude sur les terres décrites à l’annexe aux fins autorisées;
Attendu que le Canada et SaskPower ont négocié les conditions selon lesquelles la servitude doit être détenue, comme en témoigne l’accord intitulé « Specific Claims Replacement Easement Agreement for Electrical Transmission Line Right-Of-Way »;
À ces causes, sur recommandation de la ministre des Services aux Autochtones, Son Excellence la Gouverneure générale en conseil :
a) en vertu du paragraphe 35(1) de la Loi sur les Indiens, consent à ce que Saskatchewan Power Corporation (« SaskPower ») exerce son pouvoir de prendre, conformément à la loi de la Saskatchewan intitulée The Power Corporation Act, R.S.S. 1978, ch. P-19, une servitude sur les terres décrites à l’annexe aux fins de la construction, de l’exploitation et de l’entretien d’une ligne de transmission d’électricité (« les fins autorisées»), sous réserve des conditions énoncées à l’alinéa b);

b) en vertu du paragraphe 35(3) de la Loi sur les Indiens, au lieu de la prise par SaskPower de la servitude faisant l’objet du consentement prévu à l’alinéa a), autorise l’octroi à SaskPower de la servitude sur les terres décrites à l’annexe aux fins autorisées, aux conditions suivantes :
(i) les conditions selon lesquelles la servitude doit être détenue sont conformes en substance à celles énoncées dans l’accord intitulé « Specific Claims Replacement Easement Agreement for Electrical Transmission Line Right-Of-Way »,
(ii) la servitude ainsi octroyée sera délaissée lorsqu’elle ne sera plus requise pour les fins autorisées.
