Whereas the Canadian Radio-television and Telecommunications Commission (“Commission”), in its Broadcasting Decision CRTC 2022-165 of June 22, 2022, made a decision to renew the broadcasting licences for the English- and French-language audiovisual and audio services of the Canadian Broadcasting Corporation;
Whereas, subsequent to the making of the decision, the Governor in Council received 16 petitions in writing requesting that the decision be set aside or referred back to the Commission for reconsideration and hearing;
Whereas the Canadian Broadcasting Corporation, as the national public broadcaster, is a pillar of Canada’s broadcasting system and contributes significantly to the achievement of the objectives of the broadcasting policy for Canada set out in subsection 3(1) of the Broadcasting Act;
Whereas certain categories of programming remain essential to the attainment of those policy objectives and to the maintenance and enhancement of national identity and cultural sovereignty;
Whereas the Governor in Council recognizes that regulation needs to be adaptable in order to respond to the realities of the evolving broadcasting landscape;

And whereas the Governor in Council, having considered the petitions, is satisfied that the decision derogates from the attainment of the objectives of the broadcasting policy for Canada set out in subsection 3(1) of the Broadcasting Act and, in particular, subparagraphs 3(1)(i)(i), (ii) and (v) and subparagraphs 3(1)(m)(ii), (iv), (v) and (vii) of that Act;
Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, under section 28 of the Broadcasting Act,
(a) refers back to the Commission for reconsideration and hearing the decision contained in Broadcasting Decision CRTC 2022-165 of June 22, 2022, to renew the broadcasting licences for the English- and French-language audiovisual and audio services of the Canadian Broadcasting Corporation; and
(b) is of the opinion that it is material to the reconsideration and hearing that the Commission consider how to ensure that, as the national public broadcaster, the Canadian Broadcasting Corporation continue to make a significant contribution to the creation, presentation, and dissemination of local news, children’s programming, original French-language programming, and programming produced by independent producers.
Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes (« Conseil ») a, dans sa décision de radiodiffusion CRTC 2022-165 du 22 juin 2022, pris la décision de renouveler les licences de radiodiffusion des services audiovisuels et audio de langue française et de langue anglaise de la Société Radio-Canada;
Attendu que, à la suite de cette décision, la gouverneure en conseil a reçu seize demandes écrites d’annulation ou de renvoi au Conseil pour réexamen et nouvelle audience de cette décision;
Attendu que la Société Radio-Canada, en tant que radiodiffuseur public national, est un pilier du système canadien de radiodiffusion et qu'elle contribue de façon importante à la réalisation des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion;
Attendu que certaines catégories d’émissions demeurent essentielles à la réalisation de ces objectifs politiques ainsi que pour le maintien et la valorisation de l’identité nationale et de la souveraineté culturelle;
Attendu que la gouverneure en conseil reconnaît que la réglementation doit pouvoir s’adapter pour répondre aux réalités du nouvel environnement de la radiodiffusion;

Attendu que la gouverneure en conseil, après avoir examiné les demandes, est convaincue que cette décision ne va pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion et, en particulier, aux sous-alinéas 3(1)i)(i), (ii) et (v) et aux sous-alinéas 3(1)m)(ii), (iv), (v) et (vii) de cette loi;
À ces causes, sur recommandation du ministre du Patrimoine canadien et en vertu de l’article 28 de la Loi sur la radiodiffusion, Son Excellence la Gouverneure générale en conseil :
a) renvoie au Conseil pour réexamen et nouvelle audience la décision prise dans la décision de radiodiffusion CRTC 2022-165 du 22 juin 2022 de renouveler les licences de radiodiffusion des services audiovisuels et audio de langue française et de langue anglaise de la Société Radio-Canada;
b) est d’avis qu’il est essentiel que, dans le cadre de son réexamen et de sa nouvelle audience, le Conseil étudie comment s’assurer que la Société Radio-Canada, à titre de radiodiffuseur public national, continue à contribuer de façon importante à la création, à la présentation et à la dissémination de nouvelles locales, d’émissions pour enfants, d’émissions originales en langue française et d’émissions produites par des producteurs indépendants.
