Whereas the Quebec Port Authority has proposed the development of the Laurentia Project: Port of Quebec Deep-Water Wharf – Beauport Sector in Quebec;

Whereas, on August 28, 2019, the Impact Assessment Act came into force and the Canadian Environmental Assessment Act, 2012 (“Act”) was repealed;

Whereas the project was a designated project that was subject to an environmental assessment commenced by the Canadian Environmental Assessment Agency under the Act and, in accordance with subsection 181‍(1) of the Impact Assessment Act, the environmental assessment is continued under the Act as if the Act had not been repealed;

Whereas, on June 10, 2021, after having considered the Impact Assessment Agency of Canada’s report presented in respect of the project and having taken into account the implementation of mitigation measures that the Minister of the Environment considered appropriate, the Minister decided that the project is likely to cause significant adverse environmental effects on fish and fish habitat, the current use of lands and resources for traditional purposes by Indigenous peoples, air quality, human health and socio-economic conditions;

And whereas, after having made that decision, the Minister has, in accordance with subsection 52‍(2) of the Act, referred to the Administrator in Council the matter of whether those effects are justified in the circumstances;

Therefore, His Excellency the Administrator of the Government of Canada in Council, on the recommendation of the Minister of the Environment, pursuant to subsection 52‍(4) of the Canadian Environmental Assessment Act, 2012, decides that the significant adverse environmental effects likely to be caused by the Laurentia Project: Port of Quebec Deep-Water Wharf – Beauport Sector in Quebec, proposed by the Quebec Port Authority, are not justified in the circumstances.

Attendu que l’Administration portuaire de Québec a proposé l’aménagement du projet Laurentia : Quai en eau profonde dans le port de Québec – Secteur de Beauport (Québec);

Attendu que, le 28 août 2019, la Loi sur l’évaluation d’impact est entrée en vigueur et la Loi canadienne sur l’évaluation environnementale (2012) (la « ‍Loi‍ ») a été abrogée;

Attendu qu’il s’agissait d’un projet désigné assujetti à une évaluation environnementale commencée sous le régime de la Loi par l’Agence canadienne d’évaluation environnementale et que, en application du paragraphe 181‍(1) de la Loi sur l’évaluation d’impact, cette évaluation se poursuit sous le régime de la Loi comme si celle-ci n’était pas abrogée;

Attendu que, le 10 juin 2021, après avoir pris en compte le rapport de l’Agence canadienne d’évaluation d’impact relatif au projet, le ministre de l’Environnement a décidé, compte tenu de la mise en œuvre des mesures d’atténuation qu’il estime indiquées, que la réalisation du projet est susceptible d’entraîner des effets environnementaux négatifs importants sur le poisson et son habitat, sur la qualité de l’air et la santé humaine, sur l’usage courant des terres et des ressources par les peuples autochtones à des fins traditionnelles ainsi que sur les conditions socioéconomiques;

Attendu que, après avoir pris cette décision, le ministre a renvoyé à l’administrateur en conseil, en application du paragraphe 52‍(2) de la Loi, la question de savoir si ces effets sont justifiables dans les circonstances,
