Whereas the Governor in Council is of the opinion, based on the declaration of a pandemic by the World Health Organization, that there is an outbreak of a communicable disease, namely coronavirus disease 2019 (COVID-19), in the majority of foreign countries;

 

Whereas the Governor in Council is of the opinion that the introduction or spread of the disease would pose an imminent and severe risk to public health in Canada;

 

Whereas the Governor in Council is of the opinion that the entry of persons into Canada who have recently been in a foreign country may introduce or contribute to the spread of the disease in Canada;

 

And whereas the Governor in Council is of the opinion that no reasonable alternatives to prevent the introduction or spread of the disease are available;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 58 of the Quarantine Act, makes the annexed Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States).

 


 

Attendu que la gouverneure en conseil est d’avis, compte tenu de la déclaration de pandémie de l’Organisation mondiale de la santé, que la majorité des pays étrangers est aux prises avec l’apparition d’une maladie transmissible, soit la maladie à coronavirus 2019 (COVID-19);

 

Attendu que la gouverneure en conseil est d’avis que l’introduction ou la propagation de cette maladie présenterait un danger grave et imminent pour la santé publique au Canada;

 

Attendu que la gouverneure en conseil est d’avis que l’entrée au Canada de personnes qui ont récemment séjourné dans un pays étranger favoriserait l’introduction ou la propagation de la maladie au Canada;

 

Attendu que la gouverneure en conseil est d’avis qu’il n’existe aucune autre solution raisonnable permettant de prévenir l’introduction ou la propagation de la maladie au Canada,

 

À ces causes, sur recommandation de la ministre de la Santé et en vertu de l’article 58 de la Loi sur la mise en quarantaine, Son Excellence la Gouverneure générale en conseil prend le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis), ci-après.

 


Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States)

 

Definitions

1 The following definitions apply in this Order.

common-law partner has the same meaning as in subsection 1‍(1) of the Immigration and Refugee Protection Regulations. (conjoint de fait)

dependent child has the same meaning as in section 2 of the Immigration and Refugee Protection Regulations. (enfant à charge)

extended family member, in respect of a person, means

(a) an individual who is in an exclusive dating relationship with the person, has been in such a relationship for at least one year and has spent time in the physical presence of the person during the course of the relationship;

(b) a dependent child of the person referred to in paragraph (a);

(c) a child of the person or of the person’s spouse, common-law partner or the person referred to in paragraph (a) other than a dependent child;

(d) a dependent child of the child referred to in paragraph (c);

(e) a sibling, half-sibling or step-sibling of the person or of the person’s spouse or common-law partner; or

(f) a grandparent of the person or of the person’s spouse or common-law partner. (membre de la famille élargie)

foreign national has the same meaning as in subsection 2‍(1) of the Immigration and Refugee Protection Act. (étranger)

immediate family member, in respect of a person, means

(a) the spouse or common-law partner of the person;

(b) a dependent child of the person or of the person’s spouse or common-law partner;

(c) a dependent child of the dependent child referred to in paragraph (b);

(d) the parent or step-parent of the person or of the person’s spouse or common-law partner; or

(e) the guardian or tutor of the person. (membre de la famille immédiate)

permanent resident has the same meaning as in subsection 2‍(1) of the Immigration and Refugee Protection Act. (résident permanent)

protected person means a protected person within the meaning of subsection 95‍(2) of the Immigration and Refugee Protection Act. (personne protégée)

temporary resident means a temporary resident within the meaning of the Immigration and Refugee Protection Act. (résident temporaire)

 

Prohibition — signs and symptoms

2(1) A foreign national is prohibited from entering Canada from the United States if they have reasonable grounds to suspect they have COVID-19, if they have signs and symptoms of COVID-19, including a fever and cough or a fever and difficulty breathing, or if they know they have COVID-19.

 

Non-application — certain persons

(2) Subsection (1) does not apply to persons referred to in subsection 5‍(1) or (2) who seek to enter Canada from the United States for the purpose of making a claim for refugee protection.

 

Prohibition — optional or discretionary purpose

3(1) A foreign national is prohibited from entering Canada from the United States if they seek to enter for an optional or discretionary purpose, such as tourism, recreation or entertainment.

 

Non-application — immediate family member

(2) Subsection (1) does not apply to a foreign national who is an immediate family member of a Canadian citizen, permanent resident or person registered as an Indian under the Indian Act if the foreign national intends to enter Canada to be with the Canadian citizen, permanent resident or person registered as an Indian and can demonstrate their intent to stay in Canada for a period of at least 15 days.

 

Non-application — extended family member

(3) Subsection (1) does not apply to a foreign national who is an extended family member of a Canadian citizen, permanent resident or person registered as an Indian under the Indian Act if the foreign national

(a) intends to enter Canada to be with the Canadian citizen, permanent resident or person registered as an Indian and can demonstrate their intent to stay in Canada for a period of at least 15 days;

(b) has a statutory declaration attesting to their relationship with the Canadian citizen, permanent resident or person registered as an Indian that is signed by the Canadian citizen, permanent resident or person registered as an Indian; and

(c) is authorized, in writing, by an officer designated under subsection 6‍(1) of the Immigration and Refugee Protection Act to enter Canada for the purpose referred to in paragraph (a)‍.

 

Prohibition — extended family member

3.1 A foreign national who is an extended family member of a Canadian citizen, permanent resident or person registered as an Indian under the Indian Act and who intends to enter Canada to be with the Canadian citizen, permanent resident or person registered as an Indian is prohibited from entering Canada from the United States unless the foreign national

(a) has a statutory declaration attesting to their relationship with the Canadian citizen, permanent resident or person registered as an Indian that is signed by the Canadian citizen, permanent resident or person registered as an Indian; and

(b) is authorized, in writing, by an officer designated under subsection 6‍(1) of the Immigration and Refugee Protection Act to enter Canada for that purpose.

 

Prohibition — other orders

4(1) A foreign national is prohibited from entering Canada from the United States if, based on the purpose of entry and the length of their stay, they cannot comply with the applicable requirement to quarantine under any order made under section 58 of the Quarantine Act.

 

Non-application — certain persons

(2) Subsection (1) does not apply to persons referred to in subsections 5‍(1) or (2) who seek to enter Canada from the United States for the purpose of making a claim for refugee protection.

 

Prohibition — claim for refugee protection

5(1) A foreign national is prohibited from entering Canada from the United States for the purpose of making a claim for refugee protection unless the person

(a) seeks to enter Canada at a land port of entry designated by the Minister of Public Safety and Emergency Preparedness under section 26 of the Immigration and Refugee Protection Regulations and

(i) is a claimant referred to in section 159.2, 159.5 or 159.6 of the Immigration and Refugee Protection Regulations, or

(ii) is a citizen of the United States; or

 

(b) is a person or any person in a class of persons whose presence in Canada is determined by the Minister of Public Safety and Emergency Preparedness or the Minister of Citizenship and Immigration to be in the national or public interest, while recognizing the paramount public health interests of Canada and Canadians.

 

Non-application — certain persons

(2) Subsection (1) does not apply to the following persons who seek to enter Canada at any place referred to in paragraph 159.4‍(1)‍(a), (b) or (c) of the Immigration and Refugee Protection Regulations:

(a) a citizen of the United States;

(b) a stateless habitual resident of the United States; or

(c) a person who

(i) has not attained the age of 18 years and is not accompanied by their mother, father or legal guardian within the meaning of the Immigration and Refugee Protection Regulations,

(ii) has neither a spouse nor a common-law partner within the meaning of those Regulations, and

(iii) has neither a mother or father nor a legal guardian within the meaning of those Regulations in the United States.

 

Prohibition — international students

5.1(1) The following persons are prohibited from entering Canada from the United States for the purpose of attending an institution other than a listed institution:

(a) a person who holds a valid study permit as defined in section 2 of the Immigration and Refugee Protection Regulations;

(b) a person who may apply for a study permit when entering Canada under section 214 of those Regulations; or

(c) a person whose application for a study permit was approved under the Immigration and Refugee Protection Act and who received written notice of the approval but who has not yet been issued the permit.

 

Listed institution

(2) For the purposes of subsection (1), a listed institution is an institution that is

 

(a) determined, by the government of the province in which the institution is located, to have appropriate measures in place to ensure that the students who attend the institution can meet applicable obligations under any order with respect to mandatory isolation or quarantine made under section 58 of the Quarantine Act; and

(b) included in a list that is published by the Department of Citizenship and Immigration on its website, as amended from time to time, for the purposes of this Order.

 

Non-application — compassionate grounds

5.2 Subsection 3‍(1), section 3.1 and subsection 4‍(1) do not apply to a foreign national if

(a) the Minister of Health

(i) determines that the foreign national intends to enter Canada in order to engage in one of the following activities:

(A) to attend to the death of or provide support to a Canadian citizen, permanent resident, temporary resident or protected person, or person registered as an Indian under the Indian Act, who is residing in Canada and who is deemed to be critically ill by a licensed health care practitioner,

(B) to provide care for a Canadian citizen, permanent resident, temporary resident or protected person, or person registered as an Indian under the Indian Act, who is residing in Canada and who is deemed by a licensed health care practitioner to have a medical reason that they require support, or

(C) to attend a funeral or end-of-life ceremony,

(ii) in the case where a foreign national is, based on the purpose of entry and the length of their stay, unable to comply with the applicable requirement to quarantine under any order made under section 58 of the Quarantine Act,

(A) has not received written notice from the government of the province where the activity referred to in subparagraph (i) will take place indicating that that government opposes the non-application of subsection 3‍(1), section 3.1 and subsection 4‍(1) to persons who engage in such an activity in that province and who are unable to comply with the applicable requirement to quarantine under any order made under section 58 of the Quarantine Act, and

(B) if the foreign national intends to engage in the activity referred to in subparagraph (i) in a location other than a public outdoor location, determines that the person in charge of the location does not object to the presence of the foreign national at that location in order to engage in that activity; or

 

(b) the foreign national has obtained a limited release from quarantine on compassionate grounds under an order with respect to mandatory isolation or quarantine made under section 58 of the Quarantine Act for the activity referred to in subparagraph (a)‍(i)‍.

 

Non-application — order

6 This Order does not apply to

(a) a person registered as an Indian under the Indian Act;

(b) a person who, as determined by the Chief Public Health Officer appointed under subsection 6‍(1) of the Public Health Agency of Canada Act, does not pose a risk of significant harm to public health;

(c) a protected person; or

(d) a person who enters Canadian waters, including the inland waters, or the airspace over Canada on board a conveyance while proceeding directly from one place outside Canada to another place outside Canada, as long as the person was continuously on board that conveyance while in Canada and

(i) in the case of a conveyance other than an aircraft, the person did not land in Canada and the conveyance did not make contact with another conveyance, moor or anchor while in Canadian waters, including the inland waters, other than anchoring carried out in accordance with the right of innocent passage under international law, or

(ii) in the case of an aircraft, the conveyance did not land while in Canada.

 

Powers and obligations

7 For greater certainty, this Order does not affect any of the powers and obligations set out in the Quarantine Act.

 

Repeal

8 The Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States)1 is repealed.

 

Effective period

9 This Order has effect for the period beginning at 11:59:59 p.m. Eastern Standard Time on November 21, 2020 and ending at 11:59:59 p.m. Eastern Standard Time on December 21, 2020.

Définitions

membre de la famille élargie S’entend, à l’égard d’une personne :

a) de la personne avec qui la personne en cause entretient une relation amoureuse exclusive depuis au moins un an et qui a passé du temps en la présence physique de la personne en cause pendant la relation;

b) de l’enfant à charge de la personne visée à l’alinéa a);

c) de son enfant ou de l’enfant de son époux, de son conjoint de fait ou de la personne visée à l’alinéa a) autre qu’un enfant à charge;

d) de l’enfant à charge d’un enfant visé au paragraphe c);

e) de l’un des enfants de l’un ou l’autre de ses parents ou de ses beaux-parents ou des enfants de l’un ou l’autre des parents ou des beaux-parents de son époux ou conjoint de fait;

f) de l’un de ses grands-parents ou des grands-parents de son époux ou conjoint de fait. (extended family member)

a) de son époux ou conjoint de fait;

b) de son enfant à charge ou de celui de son époux ou conjoint de fait;

Interdiction — signes et symptômes

2(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis s’il a des motifs raisonnables de soupçonner qu’il est atteint de la COVID-19, s’il présente des signes et des symptômes de la COVID-19, notamment de la fièvre et de la toux ou de la fièvre et des difficultés respiratoires, ou s’il se sait atteint de la COVID-19.

 

Non-application — certaines personnes

(2) Le paragraphe (1) ne s’applique pas aux personnes visées aux paragraphes 5‍(1) ou (2) qui cherchent à entrer au Canada en provenance des États-Unis afin de faire une demande d’asile.

 

Interdiction — fins de nature optionnelle ou discrétionnaire

3(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis s’il cherche à le faire à des fins de nature optionnelle ou discrétionnaire, telles que le tourisme, les loisirs ou le divertissement.

 

Non-application — membre de la famille immédiate

(2) Le paragraphe (1) ne s’applique pas à l’étranger qui est un membre de la famille immédiate d’un citoyen canadien, d’un résident permanent ou d’une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens, qui a l’intention d’entrer au Canada pour être avec le citoyen canadien, le résident permanent ou la personne inscrite à titre d’Indien et qui peut démontrer son intention de demeurer au Canada pendant une période d’au moins quinze jours.

 

Non-application — membre de la famille élargie

(3) Le paragraphe (1) ne s’applique pas à l’étranger qui est un membre de la famille élargie d’un citoyen canadien, d’un résident permanent ou d’une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens et qui, à la fois :

a) a l’intention d’entrer au Canada pour être avec le citoyen canadien, le résident permanent ou la personne inscrite à titre d’Indien et peut démontrer son intention de demeurer au Canada pendant une période d’au moins quinze jours;

b) possède une affirmation solennelle, signée par le citoyen canadien, le résident permanent ou la personne inscrite à titre d’Indien, attestant sa relation avec celui-ci;

c) est autorisé par écrit, par un agent désigné au titre du paragraphe 6‍(1) de la Loi sur l’immigration et la protection des réfugiés, à entrer au Canada à la fin visée à l’alinéa a)‍.

 

Interdiction — membre de la famille élargie

3.1 Il est interdit à tout étranger qui est un membre de la famille élargie d’un citoyen canadien, d’un résident permanent ou d’une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens d’entrer au Canada en provenance des États-Unis s’il cherche à le faire pour être avec le citoyen canadien, le résident permanent ou la personne inscrite à titre d’Indien, sauf si, à la fois :

a) il possède une affirmation solennelle, signée par le citoyen canadien, le résident permanent ou la personne inscrite à titre d’Indien, attestant sa relation avec celui-ci;

b) il est autorisé par écrit, par un agent désigné au titre du paragraphe 6‍(1) de la Loi sur l’immigration et la protection des réfugiés, à entrer au Canada aux fins en cause.

 

Interdiction — autres décrets

4(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis s’il lui est impossible, compte tenu des fins auxquelles il cherche à y entrer ou de la durée prévue de son séjour, de se conformer à l’obligation applicable de se mettre en quarantaine aux termes de tout décret pris en vertu de l’article 58 de la Loi sur la mise en quarantaine.

 

Non-application — certaines personnes

(2) Le paragraphe (1) ne s’applique pas aux personnes visées aux paragraphes 5‍(1) ou (2) qui cherchent à entrer au Canada en provenance des États-Unis afin de faire une demande d’asile.

 

Interdiction — demande d’asile

5(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis afin de faire une demande d’asile, sauf si, selon le cas :

a) il cherche à entrer au Canada à un point d’entrée terrestre désigné par le ministre de la Sécurité publique et de la Protection civile en vertu de l’article 26 du Règlement sur l’immigration et la protection des réfugiés et est :

(i) soit un demandeur visé aux articles 159.2, 159.5 ou 159.6 du Règlement sur l’immigration et la protection des réfugiés,

(ii) soit un citoyen des États-Unis;

 

 

b) le ministre de la Sécurité publique et de la Protection civile ou le ministre de la Citoyenneté et de l’Immigration conclut que sa présence est, individuellement ou au titre de son appartenance à une catégorie de personnes, dans l’intérêt national ou dans l’intérêt public, compte tenu des intérêts primordiaux du Canada et des Canadiens en matière de santé publique.

 

Non-application — certaines personnes

(2) Le paragraphe (1) ne s’applique pas aux personnes ci-après qui cherchent à entrer au Canada à l’un des endroits visés aux alinéas 159.4‍(1)a), b) et c) du Règlement sur l’immigration et la protection des réfugiés :

a) le citoyen des États-Unis;

b) l’apatride qui a sa résidence habituelle aux États-Unis;

c) la personne qui satisfait aux exigences suivantes :

(i) elle a moins de dix-huit ans et n’est pas accompagnée par son père, sa mère ou son tuteur légal au sens du Règlement sur l’immigration et la protection des réfugiés,

(ii) elle n’a ni époux ni conjoint de fait au sens de ce règlement,

(iii) elle n’a aux États-Unis ni père, ni mère, ni tuteur légal au sens de ce règlement.

 

Interdiction — étudiants internationaux

5.1(1) Il est interdit aux personnes ci-après d’entrer au Canada en provenance des États-Unis afin d’y fréquenter un établissement autre qu’un établissement répertorié :

a) le titulaire d’un permis d’études, au sens de l’article 2 du Règlement sur l’immigration et la protection des réfugiés, qui est valide;

b) la personne qui peut faire une demande de permis d’études au moment de son entrée au Canada aux termes de l’article 214 de ce même règlement;

c) la personne qui ne s’est pas encore vu délivrer le permis d’études, mais qui a été avisée par écrit que sa demande de permis d’études a été approuvée sous le régime de la Loi sur l’immigration et la protection des réfugiés.

 

Établissement répertorié

(2) Pour l’application du paragraphe (1), est un établissement répertorié l’établissement qui :

a) de l’avis du gouvernement de la province dans laquelle il est situé, met en place des mesures appropriées pour que les étudiants qui le fréquentent puissent respecter leurs obligations aux termes de tout décret concernant l’obligation de s’isoler ou de se mettre en quarantaine pris en vertu de l’article 58 de la Loi sur la mise en quarantaine;

b) figure sur une liste publiée, avec ses modifications successives, par le ministère de la Citoyenneté et de l’Immigration sur son site Web pour l’application du présent décret.

 

Non-application — motifs d’ordre humanitaire

5.2 Le paragraphe 3‍(1), l’article 3.1 et le paragraphe 4‍(1) ne s’appliquent pas à l’étranger si l’une ou l’autre des conditions suivantes est remplie :

a) le ministre de la Santé :

(i) conclut que l’étranger cherche à entrer au Canada afin de s’adonner à l’une des activités suivantes :

(A) fournir un soutien à un citoyen canadien, à un résident permanent, à un résident temporaire, à une personne protégée ou à une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens qui réside au Canada et qu’un professionnel de la santé titulaire d’une licence ou d’un permis d’exercice juge gravement malade, ou assister au décès d’une telle personne,

(B) fournir des soins à un citoyen canadien, à un résident permanent, à un résident temporaire, à une personne protégée ou à une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens qui réside au Canada et qui, selon un professionnel de la santé titulaire d’une licence ou d’un permis d’exercice, nécessite du soutien pour une raison médicale,

(C) assister à des funérailles ou à une cérémonie de fin de vie,

(ii) dans le cas où l’étranger est, compte tenu des fins auxquelles il cherche à y entrer ou de la durée prévue de son séjour, dans l’impossibilité de se conformer à l’obligation applicable de se mettre en quarantaine aux termes de tout décret pris en vertu de l’article 58 de la Loi sur la mise en quarantaine,

(A) n’a pas reçu d’avis écrit du gouvernement de la province où se déroulera l’activité visée au sous-alinéa (i) indiquant que celui-ci s’oppose à la non-application du paragraphe 3‍(1), de l’article 3.1 et du paragraphe 4‍(1) aux personnes qui s’adonnent à une telle activité dans la province et qui sont dans l’impossibilité de se conformer à l’obligation applicable de se mettre en quarantaine aux termes de tout décret pris en vertu de l’article 58 de la Loi sur la mise en quarantaine,

(B) si l’étranger entend s’adonner à l’activité visée au sous-alinéa (i) dans tout lieu autre qu’un lieu public extérieur, conclut que le responsable du lieu ne s’oppose pas à ce que l’étranger s’y trouve pour s’adonner à cette activité,

b) l’étranger a obtenu une levée limitée de la mise en quarantaine pour motifs d’ordre humanitaire aux termes de tout décret concernant l’obligation de s’isoler ou de se mettre en quarantaine pris en vertu de l’article 58 de la Loi sur la mise en quarantaine pour l’activité visée au sous-alinéa a)‍(i)‍.

 

Non-application — décret

6 Le présent décret ne s’applique pas :

a) à la personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens;

b) à la personne qui, selon ce que conclut l’administrateur en chef nommé en vertu du paragraphe 6‍(1) de la Loi sur l’Agence de la santé publique du Canada, ne présente pas de danger grave pour la santé publique;

c) à la personne protégée;

d) à la personne qui, à bord d’un véhicule, se rend directement d’un lieu à l’extérieur du Canada à un autre lieu à l’extérieur du Canada, en passant par les eaux canadiennes, y compris les eaux internes, ou dans l’espace aérien du Canada, tant qu’elle est demeurée à bord du moyen de transport alors qu’il se trouvait au Canada et :

(i) qu’elle n’a pas mis pied au Canada et, s’agissant d’un véhicule autre qu’un aéronef, que celui-ci n’a ni amarré, ni mouillé l’ancre, ni établi de contact avec un autre véhicule, alors qu’il se trouvait dans les eaux canadiennes, notamment les eaux internes, à l’exception d’avoir mouillé l’ancre conformément au droit de passage inoffensif en vertu du droit international,

(ii) s’agissant d’un aéronef, que celui-ci n’a pas atterri alors qu’il se trouvait au Canada.

 

Pouvoirs et obligations

7 Il est entendu que le présent décret ne porte pas atteinte aux pouvoirs et aux obligations prévus par la Loi sur la mise en quarantaine.

 

Abrogation

8 Le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis)1 est abrogé.

 

Durée d’application

9 Le présent décret s’applique pendant la période commençant à 23 h 59 min 59 s, heure normale de l’Est, le 21 novembre 2020 et se terminant à 23 h 59 min 59 s, heure normale de l’Est, le 21 décembre 2020.
