Whereas the Governor in Council is of the opinion that

 

(a) based on the declaration of a pandemic by the World Health Organization, there is an outbreak of a communicable disease, namely coronavirus disease 2019 (COVID-19), in the majority of foreign countries;

 

(b) the introduction or spread of the disease would pose an imminent and severe risk to public health in Canada;

 

(c) the entry of persons into Canada who have recently been in a foreign country may introduce or contribute to the spread of the disease in Canada; and

 

(d) no reasonable alternatives to prevent the introduction or spread of the disease are available;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, pursuant to section 58 of the Quarantine Act makes the annexed Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States).

 


 

Attendu que la gouverneure en conseil est d’avis :

 

a) que, compte tenu de la déclaration de pandémie de l’Organisation mondiale de la santé, la majorité des pays étrangers est aux prises avec l’apparition d’une maladie transmissible, soit la maladie à coronavirus 2019 (COVID-19);

 

b) que l’introduction ou la propagation de cette maladie présenterait un danger grave et imminent pour la santé publique au Canada;

 

c) que l’entrée au Canada de personnes qui ont récemment séjourné dans un pays étranger favoriserait l’introduction ou la propagation de la maladie au Canada;

 

d) qu’il n’existe aucune autre solution raisonnable permettant de prévenir l’introduction ou la propagation de la maladie au Canada,

 

À ces causes, sur recommandation de la ministre de la Santé et en vertu de l’article 58 de la Loi sur la mise en quarantaine, Son Excellence la Gouverneure générale en conseil prend le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis), ci-après.

 

 


Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States)    

 

Definitions    

1 The following definitions apply in this Order.

Chief Public Health Officer means the Chief Public Health Officer appointed under subsection 6(1) of the Public Health Agency of Canada Act. (administrateur en chef)

common-law partner has the same meaning as in subsection 1(1) of the Immigration and Refugee Protection Regulations. (conjoint de fait)

dependent child has the same meaning as in section 2 of the Immigration and Refugee Protection Regulations. (enfant à charge)

extended family member, in respect of a person, means

(a) an individual who is in an exclusive dating relationship with the person, has been in such a relationship for at least one year, and has spent time in the physical presence of the person during the course of the relationship;

(b) a dependent child of the person referred to in paragraph (a);

(c) a child of the person or of the person’s spouse, common-law partner or the person referred to in paragraph (a) other than a dependent child;

(d) a dependent child of a child referred to in paragraph (c);

(e) a sibling, half-sibling or step-sibling of the person or of the person’s spouse or common-law partner; or

(f) a grandparent of the person or of the person’s spouse or common-law partner. (membre de la famille élargie)

foreign national has the same meaning as in subsection 2(1) of the Immigration and Refugee Protection Act. (étranger)

immediate family member, in respect of a person, means

(a) the spouse or common-law partner of the person;

(b) a dependent child of the person or of the person’s spouse or common-law partner;

 

 

(c) a dependent child of a dependent child referred to in paragraph (b);

(d) the parent or step-parent of the person or of the person’s spouse or common-law partner; or

(e) the guardian or tutor of the person. (membre de la famille immédiate)

permanent resident has the same meaning as in subsection 2(1) of the Immigration and Refugee Protection Act. (résident permanent)

protected person has the meaning assigned by subsection 95(2) of the Immigration and Refugee Protection Act. (personne protégée)

temporary resident has the meaning assigned by the Immigration and Refugee Protection Act. (résident temporaire)    

 

Prohibition — signs and symptoms    

2(1) A foreign national is prohibited from entering Canada from the United States if they have reasonable grounds to suspect they have COVID-19, if they have signs and symptoms of COVID-19, including a fever and cough or a fever and breathing difficulties, or if they know they have COVID-19.    

 

Non-application — certain persons    

(2) Subsection (1) does not apply to persons referred to in subsection 5(1) or (2) who seek to enter Canada from the United States for the purpose of making a claim for refugee protection.    

 

Prohibition — optional or discretionary purpose    

3(1) A foreign national is prohibited from entering Canada from the United States if they seek to enter for an optional or discretionary purpose, such as tourism, recreation or entertainment.    

 

Non-application — immediate family member    

(2) Subsection (1) does not apply to a foreign national who is an immediate family member of a Canadian citizen or a permanent resident if the foreign national intends to enter Canada to be with their immediate family member who is a Canadian citizen or a permanent resident and can demonstrate their intent to stay in Canada for a period of at least 15 days.    

 

 

 

 

Non-application — extended family member    

(3) Subsection (1) does not apply to a foreign national who is an extended family member of a Canadian citizen or a permanent resident if the foreign national

(a) intends to enter Canada to be with their extended family member who is a Canadian citizen or a permanent resident and can demonstrate their intent to stay in Canada for a period of at least 15 days;

(b) has a statutory declaration attesting to their relationship with the Canadian citizen or permanent resident that is signed by the Canadian citizen or permanent resident; and

(c) is authorized, in writing, by an officer designated under subsection 6(1) of the Immigration and Refugee Protection Act to enter Canada for the purpose referred to in paragraph (a).    

 

Prohibition — extended family member    

3.1 A foreign national who is an extended family member of a Canadian citizen or a permanent resident and who seeks to enter Canada for a purpose related to their extended family is prohibited from entering Canada from the United States unless the foreign national

(a) has a statutory declaration attesting to their relationship with the Canadian citizen or permanent resident that is signed by the Canadian citizen or permanent resident; and

(b) is authorized, in writing, by an officer designated under subsection 6(1) of the Immigration and Refugee Protection Act to enter Canada for that purpose.    

 

Prohibition — unable to meet quarantine requirement    

4(1) A foreign national is prohibited from entering Canada from the United States if, based on the purpose of entry and the length of their stay, the applicable requirement to quarantine under any order made under section 58 of the Quarantine Act with respect to mandatory isolation or quarantine cannot be complied with.    

 

Non-application — certain persons    

(2) Subsection (1) does not apply to persons referred to in subsections 5(1) or (2) who seek to enter Canada from the United States for the purpose of making a claim for refugee protection.    

 

 

 

 

 

Prohibition — claim for refugee protection    

5(1) A foreign national is prohibited from entering Canada from the United States for the purpose of making a claim for refugee protection unless the person

(a) seeks to enter Canada at a land port of entry designated by the Minister of Public Safety and Emergency Preparedness under section 26 of the Immigration and Refugee Protection Regulations and

(i) is a claimant referred to in section 159.2, 159.5 or 159.6 of the Immigration and Refugee Protection Regulations, or

(ii) is a citizen of the United States; or

(b) is a person or any person in a class of persons whose presence in Canada is determined by the Minister of Public Safety and Emergency Preparedness or the Minister of Citizenship and Immigration to be in the national or public interest, while recognizing the paramount public health interests of Canada and Canadians.    

 

Non-application — certain persons    

(2) Subsection (1) does not apply to the following persons who seek to enter Canada at any place referred to in paragraph 159.4(1)(a), (b) or (c) of the Immigration and Refugee Protection Regulations:

(a) a citizen of the United States;

(b) a stateless habitual resident of the United States; or

(c) a person who

(i) has not attained the age of 18 years and is not accompanied by their mother, father or legal guardian within the meaning of the Immigration and Refugee Protection Regulations,

(ii) has neither a spouse nor a common-law partner within the meaning of those Regulations, and

(iii) has neither a mother or father nor a legal guardian within the meaning of those Regulations in the United States.    

 

 

 

 

 

 

 

 

 

 

Prohibition — international students    

5.1(1) A person who holds a valid study permit as defined in section 2 of the Immigration and Refugee Protection Regulations, who may apply for a study permit when entering Canada under section 214 of the Immigration and Refugee Protection Regulations or whose application for a study permit was approved under the Immigration and Refugee Protection Act and who received written notice of the approval but who has not yet been issued the permit, is prohibited from entering Canada from the United States for the purpose of attending an institution other than a listed institution.    

 

Listed institution    

(2) For the purposes of subsection (1), a listed institution is an institution that is

(a) determined, by a government of a province in which the institution is located, to have appropriate measures in place to ensure that the students who attend the institution can meet applicable obligations under any order made under section 58 of the Quarantine Act with respect to mandatory isolation or quarantine; and

(b) included in a list that is published by the Department of Citizenship and Immigration on its website, as amended from time to time, for the purposes of this Order.    

 

Non-application — compassionate grounds    

5.2 Subsection 3(1), section 3.1. and subsection 4(1) do not apply to a foreign national who, as determined by the Minister of Health, intends to enter Canada to

(a) attend to the death of or provide support to a Canadian citizen, permanent resident, temporary resident, protected person, or a person registered as an Indian under the Indian Act who is residing in Canada and who is deemed by a licensed health care professional to be critically ill;

(b) provide care for a Canadian citizen, permanent resident, temporary resident, protected person, or a person registered as an Indian under the Indian Act who is residing in Canada and who is deemed by a licensed health care professional to have a medical reason as to why they require support; or

(c) attend a funeral or end of life ceremony.    

 

Non-application — Order    

6 This Order does not apply to

(a) a person registered as an Indian under the Indian Act;

(b) a person who, as determined by the Chief Public Health Officer, does not pose a risk of significant harm to public health;

(c) a protected person; or

(d) a person who enters Canadian waters, including the inland waters, or the airspace over Canada on board a conveyance while proceeding directly from one place outside Canada and leaves Canada to another place outside Canada on board the conveyance, as long as the person was continuously on board that conveyance while in Canada and, in the case of a conveyance other than an aircraft, the person did not land in Canada and the conveyance did not make contact with another conveyance, moor or anchor while in Canadian waters, including the inland waters, other than anchoring carried out in accordance with the right of innocent passage under international law and, in the case of an aircraft, the conveyance did not land while in Canada.    

 

Powers and obligations    

7 For greater certainty, this Order does not affect any of the powers and obligations set out in the Quarantine Act.    

 

Repeal    

8 The Minimizing the Risk of Exposure to COVID-19 in Canada Order (Prohibition of Entry into Canada from the United States)1 is repealed.    

 

Effective period    

9 (1) This Order, except section 5.1, has effect for the period beginning at 23:59:59 p.m. Eastern Daylight Time on the day on which it is made and ending at 23:59:59 p.m. Eastern Daylight Time on October 21, 2020.    

 

Section 5.1    

(2) Section 5.1 has effect for the period beginning at 23:59:59 p.m. Eastern Daylight Time on October 20, 2020, and ending at 23:59:59 p.m. Eastern Daylight Time on October 21, 2020.

   Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis)

 

   Définitions

1 Les définitions qui suivent s’appliquent au présent décret.

administrateur en chef L’administrateur en chef de la santé publique, nommé en application du paragraphe 6(1) de la Loi sur l’Agence de la santé publique du Canada. (Chief Public Health Officer)

conjoint de fait S’entend au sens du paragraphe 1(1) du Règlement sur l’immigration et la protection des réfugiés. (common-law partner)

enfant à charge S’entend au sens de l’article 2 du Règlement sur l’immigration et la protection des réfugiés. (dependent child)

étranger S’entend au sens du paragraphe 2(1) de la Loi sur l’immigration et la protection des réfugiés. (foreign national)

membre de la famille élargie S’entend, à l’égard d’une personne :

a) de la personne avec qui la personne en cause entretient une relation amoureuse exclusive depuis au moins un an et qui a passé du temps en la présence physique de la personne en cause pendant la relation;

b) de l’enfant à charge de la personne visée à l’alinéa a);

c) de son enfant ou de l’enfant de son époux, de son conjoint de fait ou de la personne visée à l’alinéa a) autre qu’un enfant à charge;

d) de l’enfant à charge d’un enfant visé au paragraphe c);

e) d’un des enfants de l’un ou l’autre de ses parents ou de ses beaux-parents ou des enfants de l’un ou l’autre des parents ou des beaux-parents de son époux ou conjoint de fait;

f) d’un de ses grands-parents ou des grands-parents de son époux ou conjoint de fait. (extended family member)

membre de la famille immédiate S’entend, à l’égard d’une personne :

a) de son époux ou conjoint de fait;

b) de son enfant à charge ou de celui de son époux ou conjoint de fait;

 

 

c) de l’enfant à charge d’un enfant à charge visé à l’alinéa b);

d) d’un de ses parents ou de ses beaux-parents ou des parents ou beaux-parents de son époux ou conjoint de fait;

e) de son tuteur. (immediate family member)

personne protégée S’entend au sens du paragraphe 95(2) de la Loi sur l’immigration et la protection des réfugiés. (protected person)

résident permanent S’entend au sens du paragraphe 2(1) de la Loi sur l’immigration et la protection des réfugiés. (permanent resident)

résident temporaire S’entend au sens de la Loi sur l’immigration et la protection des réfugiés. (temporary resident)

 

   Interdiction — signes et symptômes

   2(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis s’il a des motifs raisonnables de soupçonner qu’il est atteint de la COVID-19, s’il présente des signes et des symptômes de la COVID-19, notamment de la fièvre et de la toux ou une fièvre et des difficultés respiratoires, ou s’il se sait atteint de la COVID-19.

 

   Non-application — certaines personnes

   (2) Le paragraphe (1) ne s’applique pas aux personnes visées aux paragraphes 5(1) ou (2) qui cherchent à entrer au Canada en provenance des États-Unis afin de faire une demande d’asile.

 

   Interdiction — fins optionnelles ou discrétionnaires

   3(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis s’il cherche à le faire à des fins de nature optionnelle ou discrétionnaire telles que le tourisme, les loisirs ou le divertissement.

 

   Non-application — membre de la famille immédiate

   (2) Le paragraphe (1) ne s’applique pas à l’étranger qui est un membre de la famille immédiate d’un citoyen canadien ou d’un résident permanent, à condition que l’étranger ait l’intention d’entrer au Canada pour être avec un membre de sa famille immédiate qui est un citoyen canadien ou un résident permanent et qu’il puisse démontrer son intention de rester au Canada pendant une période d’au moins quinze jours.

 

 

 

 

 

   Non-application — membre de la famille élargie

(3) Le paragraphe (1) ne s’applique pas à l’étranger qui est un membre de la famille élargie d’un citoyen canadien ou d’un résident permanent, à condition que l’étranger, à la fois :

a) ait l’intention d’entrer au Canada pour être avec un membre de sa famille élargie qui est un citoyen canadien ou un résident permanent et qu’il puisse démontrer son intention de rester au Canada pendant une période d’au moins quinze jours;

b) possède une affirmation solenelle attestant de sa relation avec le citoyen canadien ou le résident permanent signée par le citoyen canadien ou le résident permanent;

c) est autorisée, par écrit, par un agent désigné en vertu du paragraphe 6(1) de la Loi sur l’immigration et la protection des réfugiés à entrer au Canada dans le but visé à l’alinéa a)‍.

 

   Interdiction — membre de la famille élargie

3.1 Il est interdit à tout étranger qui est un membre de la famille élargie d’un citoyen canadien ou d’un résident permanent d’entrer au Canada en provenance des États-Unis s’il cherche à le faire pour une fin reliée à celle-ci sauf s’il

a) possède une affirmation solennelle attestant de sa relation avec le citoyen canadien ou le résident permanent signée par le citoyen canadien ou le résident permanent;

b) est autorisée, par écrit, par un agent désigné en vertu du paragraphe 6(1) de la Loi sur l’immigration et la protection des réfugiés à entrer au Canada pour cette fin.

 

   Interdiction — mise en quarantaine impossible

   4(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis si l’obligation applicable de se mettre en quarantaine conformément à tout décret pris en vertu de l’article 58 de la Loi sur la mise en quarantaine concernant l’obligation de s’isoler ou de se mettre en quarantaine ne peut être remplie compte tenu du motif pour lequel il cherche à y entrer ou de la durée prévue de son séjour.

 

   Non-application — certaines personnes

   (2) Le paragraphe (1) ne s’applique pas aux personnes visées aux paragraphes 5(1) ou (2) qui cherchent à entrer au Canada en provenance des États-Unis afin de faire une demande d’asile.

 

 

 

 

   Interdiction — demande d’asile

5(1) Il est interdit à tout étranger d’entrer au Canada en provenance des États-Unis afin de faire une demande d’asile, sauf si, selon le cas :

a) il cherche à entrer au Canada à un point d’entrée terrestre désigné par le ministre de la Sécurité publique et de la Protection civile en vertu de l’article 26 du Règlement sur l’immigration et la protection des réfugiés et est :

(i) soit un demandeur visé aux articles 159.2, 159.5 ou 159.6 du Règlement sur l’immigration et la protection des réfugiés,

(ii) soit un citoyen des États-Unis;

b) il est une personne ou il appartient à une catégorie de personnes dont la présence au Canada est, tel qu’il est établi par le ministre de la Sécurité publique et de la Protection civile ou le ministre de la Citoyenneté et de l’Immigration, dans l’intérêt national ou dans l’intérêt public, compte tenu des intérêts primordiaux du Canada et des Canadiens en matière de santé publique.

 

   Non-application — certaines personnes

(2) Le paragraphe (1) ne s’applique pas aux personnes ci-après qui cherchent à entrer au Canada à l’un des endroits visés aux alinéas 159.4(1)a), b) ou c) du Règlement sur l’immigration et la protection des réfugiés :

a) le citoyen des États-Unis;

b) l’apatride qui a sa résidence habituelle aux États-Unis;

c) la personne qui satisfait aux exigences suivantes :

(i) elle a moins de dix-huit ans et n’est pas accompagnée par son père, sa mère ou son tuteur légal au sens du Règlement sur l’immigration et la protection des réfugiés,

(ii) elle n’a ni époux ni conjoint de fait au sens de ce règlement,

(iii) elle n’a aux États-Unis ni père, ni mère, ni tuteur légal au sens de ce règlement.

 

 

 

 

 

 

 

 

   

 

 

 

 

Interdiction — étudiants internationaux

   5.1(1) Il est interdit à toute personne d’entrer au Canada en provenance des États-Unis afin d’y fréquenter un établissement autre qu’un établissement répertorié si elle est titulaire d’un permis d’études, au sens de l’article 2 du Règlement sur l’immigration et la protection des réfugiés, valide, qui peut faire une demande de permis d’études au moment de son entrée au Canada conformément à l’article 214 du Règlement sur l’immigration et la protection des réfugiés ou qui, bien qu’ayant été avisée par écrit que sa demande visant à obtenir un permis d’études a été approuvée sous le régime de la Loi sur l’immigration et la protection des réfugiés, ne s’est pas encore vue délivrer le permis d’études.

 

   Établissement répertorié

(2) Pour l’application du paragraphe (1), un établissement répertorié est un établissement :

a) qui, de l’avis du gouvernement de la province dans laquelle il est situé, met en place des mesures appropriées pour s’assurer que les étudiants qui le fréquentent peuvent respecter leurs obligations, conformément à tout décret pris en vertu de l’article 58 de la Loi sur la mise en quarantaine concernant l’obligation de s’isoler ou de se mettre en quarantaine;

b) qui figure sur une liste qui est publiée, avec ses modifications successives, par le ministère de la Citoyenneté et de l’Immigration sur son site Web pour l’application du présent décret.

 

   Non-application — motifs d’ordre humanitaire

5.2 Le paragraphe 3(1), l’article 3.1 et le paragraphe 4(1) ne s’appliquent pas à un étranger si le ministre de la Santé conclut que cet étranger cherche à entrer au Canada afin :

a) de fournir un soutien à un citoyen canadien, à un résident permanent, à un résident temporaire, à une personne protégée ou à une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens qui réside au Canada ou d’assister à la mort d’une telle personne, si un professionnel de la santé titulaire d’une licence ou d’un permis d’exercice est d’avis que la personne est gravement malade;

b) de fournir des soins à un citoyen canadien, à un résident permanent, à un résident temporaire, à une personne protégée ou à une personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens qui réside au Canada, si un professionnel de la santé titulaire d’une licence ou d’un permis d’exercice est d’avis que ces soins sont médicalement justifiés;

 

c) d’assister à des funérailles ou à une cérémonie de fin de vie.

 

   Non-application — décret

6 Le présent décret ne s’applique pas :

a) à la personne inscrite à titre d’Indien sous le régime de la Loi sur les Indiens;

b) à la personne qui, tel qu’il est établi par l’administrateur en chef, ne présente pas de danger grave pour la santé publique;

c) à la personne protégée;

d) à la personne qui, à bord d’un véhicule, se rend directement d’un lieu à l’extérieur du Canada à un autre lieu à l’extérieur du Canada en passant par les eaux canadiennes, y compris les eaux internes, ou dans l’espace aérien du Canada et qui quitte ensuite le Canada à bord de ce véhicule, tant qu’elle est demeurée à bord du véhicule alors qu’il se trouvait au Canada et, s’il s’agit d’un véhicule autre qu'un aéronef, la personne n’a pas mis pied à terre au Canada et le véhicule n’est pas entré en contact avec un autre véhicule, ne s’est pas amarré ou ancré pendant qu'il se trouvait dans les eaux canadiennes, y compris les eaux intérieures, à l’exception d’un ancrage effectué conformément au droit de passage inoffensif en vertu du droit international ou, s’il s’agit d’un aéronef, le véhicule n’a pas atterri alors qu’il se trouvait au Canada.

 

   Pouvoirs et obligations

   7 Il est entendu que le présent décret ne porte pas atteinte aux pouvoirs et aux obligations prévus par la Loi sur la mise en quarantaine.

 

   Abrogation

   8 Le Décret visant la réduction du risque d’exposition à la COVID-19 au Canada (interdiction d’entrée au Canada en provenance des États-Unis)1 est abrogé.

 

   Durée d’application

   9 (1) Le présent décret, sauf l’article 5.1, s’applique pendant la période commençant à 23 h 59 min 59 s, heure avancée de l’Est, le jour de sa prise et se terminant à 23 h 59 min 59 s, heure avancée de l’Est, le 21 octobre 2020.

 

 

 

   Article 5.1

   (2) L’article 5.1 s’applique pendant la période commençant à 23 h 59 min 59 s, heure avancée de l’Est, le 20 octobre 2020 et se terminant à 23 h 59 min 59 s, heure avancée de l’Est, le 21 octobre 2020.
