Whereas the Canadian Radio-television and Telecommunications Commission (“Commission”), in its Broadcasting Decision CRTC 2019-172 of May 23, 2019, made a decision to issue to Rogers Media Inc. a broadcasting licence to operate a national, multilingual multi-ethnic discretionary service known as OMNI Regional;

Whereas, subsequent to the making of the decision, the Governor in Council received petitions in writing requesting that the decision be set aside or referred back to the Commission for reconsideration and hearing;

And whereas the Governor in Council, having considered the petitions, is satisfied that the decision does not derogate from the attainment of the objectives of the broadcasting policy for Canada set out in subsection 3(1) of the Broadcasting Act;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, declines to set aside or refer back to the Commission for reconsideration and hearing the decision contained in Broadcasting Decision CRTC 2019-172 of May 23, 2019 to issue a broadcasting licence to Rogers Media Inc. to operate a national, multilingual multi-ethnic discretionary service known as OMNI Regional.

Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes (« Conseil ») a, dans sa décision de radiodiffusion CRTC 2019-172 du 23 mai 2019, pris la décision d’attribuer à Rogers Media Inc. une licence de radiodiffusion visant l’exploitation d’un service national facultatif multilingue à caractère multiethnique appelé OMNI Regional;

Attendu que, à la suite de cette décision, la gouverneure en conseil a reçu des demandes écrites visant l’annulation de cette décision ou son renvoi au Conseil pour réexamen et nouvelle audience;

Attendu que la gouverneure en conseil, après avoir examiné les demandes, n’est pas convaincue que cette décision ne va pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion,

À ces causes, sur recommandation du ministre du Patrimoine canadien et en vertu de l’article 28 de la Loi sur la radiodiffusion, Son Excellence la Gouverneure générale en conseil refuse d’annuler ou de renvoyer au Conseil pour réexamen et nouvelle audience la décision, prise dans la décision de radiodiffusion CRTC 2019-172 du 23 mai 2019, d’attribuer à Rogers Media Inc. une licence de radiodiffusion visant l’exploitation d’un service national facultatif multilingue à caractère multiethnique appelé OMNI Regional.
