Whereas Tsay Keh Dene is a band as defined in the Indian Act;

 

And whereas Her Majesty the Queen in Right of Canada, Tsay Keh Dene First Nation, British Columbia and British Columbia Hydro and Power Authority entered into a Settlement Agreement dated September 22, 1989, which was first amended on March 17, 1994, and then on August 31, 2009, which provides that the Minister of Indian Affairs and Northern Development will recommend that the Governor in Council set apart lands selected by Tsay Keh Dene to be created as Reserves;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, in accordance with the Settlement Agreement, sets apart for the use and benefit of Tsay Keh Dene First Nation, Finlay River Indian Reserve No. 6, Mesilinka Indian Reserve No. 7 and Ingenika Indian Reserve No. 8 in British Columbia, the lands described in the attached Schedule A, consisting of 1,241.82 hectares (3,068.60 acres) more or less, subject to the interests described in the attached Schedule B.


 

Attendu que Tsay Keh Dene est une bande au sens de la Loi sur les Indiens;

 

Attendu que Sa Majesté la Reine du chef du Canada, la première nation Tsay Keh Dene, la Colombie-Britannique et la British Columbia Hydro and Power Authority ont conclu un accord de règlement en date du 22 septembre 1989. Cet accord, modifié le 17 mars 1994, puis le 31 août 2009, prévoit que la ministre des Affaires indiennes et du Nord canadien recommande à la gouverneure en conseil de mettre de côté les terres choisies par la première nation Tsay Keh Dene en vue de créer des réserves,

 

À ces causes, sur recommandation de la ministre des Affaires indiennes et du Nord canadien et conformément à l’accord de règlement, Son Excellence la Gouverneure générale en conseil met de côté, à l’usage et au profit de la première nation des Tsay Keh Dene, la réserve indienne de Finlay River no 6, la réserve indienne de Mesilinka no 7 et la réserve indienne d’Ingenika no 8 en Colombie-Britannique, les terres délimitées à l’annexe A ci-jointe et comprenant environ 1 241,82 hectares (3 068,60 acres), sous réserve des intérêts figurant à l’annexe B ci-jointe.

FINLAY RIVER INDIAN RESERVE NO. 6

 

In the Province of British Columbia

In Cassiar District

 

Firstly, all of Block A of District Lot 7126 as shown on plan EPC 990 filed in the office of the Surveyor General of British Columbia in Victoria. Containing about 805 hectares.

 

Secondly, District Lot 7372 as shown on plan EPC 497 filed in the office of the Surveyor General of British Columbia in Victoria. Containing about 47.8 hectares.

 

Copies of the said plans are recorded in the Canada Lands Surveys Records at Ottawa under numbers 105083 and 97862. Together, Block A of District Lot 7126 and District Lot 7372 contain about 852.80 hectares (2,107.31 acres).

 

MESILINKA INDIAN RESERVE NO. 7

 

In the Province of British Columbia

In Cassiar District

 

All of District Lot 7131 shown on plan 8T 1840 filed in the office of the Surveyor General of British Columbia in Victoria. A copy of the said plan is recorded in the Canada Lands Surveys Records at Ottawa under number 84062. Containing about 387 hectares (956.30 acres).

 

INGENIKA INDIAN RESERVE NO. 8

 

In the Province of British Columbia

In Cassiar District

 

All of District Lot 7120 shown on plan 7T 1606 filed in the office of the Surveyor General of British Columbia, in Victoria. A copy of the said plan is recorded in the Canada Lands Surveys Records at Ottawa under number 75536. Containing about 2.02 hectares (4.99 acres).

RÉSERVE INDIENNE DE FINLAY RIVER NO 6

Premièrement, la totalité du bloc A du lot de district 7126, comme illustré sur le plan EPC 990 déposé au bureau de l’arpenteur général de la Colombie-Britannique, à Victoria. La superficie des terres est d’environ 805 hectares.

 

Deuxièmement, le lot de district 7372, comme illustré sur le plan EPC 497 déposé au bureau de l’arpenteur général de la Colombie-Britannique, à Victoria. La superficie des terres est d’environ 47,8 hectares.

 

Des copies de ces plans sont consignées aux archives d’arpentage des terres du Canada, à Ottawa, sous les numéros 105083 et 97862. Ensemble, le bloc A du lot de district 7126 et le lot de district 7372 ont une superficie d’environ 852,80 hectares (2 107,31 acres).
