Whereas Saskatchewan Power Corporation is empowered by The Power Corporation Act, R.S.S. 1978, c. P-19, to take an interest in lands without the consent of the owner for electrical transmission and fibre optic cable line right-of-way purposes;

And whereas Saskatchewan Power Corporation requires an easement on certain lands in Star Blanket Cree Nation’s Atim Ka-mihkosit Reserve, in Saskatchewan, described in the attached Schedule “A” (Lands), for electrical transmission and fibre optic cable line right-of-way purposes;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of State styled Minister of Indigenous Services and in accordance with the Saskatchewan Treaty Land Entitlement Framework Agreement dated September 22, 1992,

(a) pursuant to subsection 35(1) of the Indian Act, consents to the exercise by Saskatchewan Power Corporation of the power to take, without the consent of the owner, in accordance with The Power Corporation Act, R.S.S. 1978, c. P-19, the easement described in the easement agreement entitled “Treaty Land Entitlement Replacement Easement Agreement for Electrical Transmission & Fibre Optic Cable Line Right-of-Way” between Her Majesty in right of Canada and Saskatchewan Power Corporation, for electrical transmission and fibre optic cable line right-of-way purposes, affecting the Lands, subject to the term that the easement be relinquished by Saskatchewan Power Corporation to Her Majesty in right of Canada when no longer required for those purposes; and

(b) pursuant to subsection 35(3) of the Indian Act, in lieu of Saskatchewan Power Corporation taking the easement as consented to in paragraph (a), authorizes the grant to Saskatchewan Power Corporation of the easement described in the easement agreement entitled “Treaty Land Entitlement Replacement Easement Agreement for Electrical Transmission & Fibre Optic Cables Line Right-of-Way” between Her Majesty in right of Canada and Saskatchewan Power Corporation, for electrical transmission and fibre optic cable line right-of-way purposes, affecting the Lands, subject to the term that the easement be relinquished by Saskatchewan Power Corporation to Her Majesty in right of Canada when no longer required for those purposes.

Attendu que la Saskatchewan Power Corporation, en vertu de la loi intitulée The Power Corporation Act, R.S.S. 1978, ch. P-19, a le pouvoir de prendre un intérêt foncier sans le consentement du propriétaire pour les besoins d’une ligne de transport d’électricité et d’une ligne de transmission par câbles à fibres optiques;

Attendu que la Saskatchewan Power Corporation requiert une servitude sur certaines terres de la réserve Atim Ka-mihkosit de Star Blanket Cree Nation, en Saskatchewan, délimitées à l’annexe « A » ci-jointe (terres), pour les besoins d’une ligne de transport d’électricité et d’une ligne de transmission par câbles à fibres optiques,

À ces causes, sur recommandation du ministre d’État portant le titre de ministre des Services aux Autochtones et aux termes de l’accord intitulé « Saskatchewan Treaty Land Entitlement Framework Agreement » du 22 septembre 1992, Son Excellence la Gouverneure générale en conseil :

a) en vertu du paragraphe 35(1) de la Loi sur les Indiens, consent à l’exercice par la Saskatchewan Power Corporation du pouvoir de prendre, sans le consentement du propriétaire, conformément à la loi intitulée The Power Corporation Act, R.S.S. 1978, ch. P-19, la servitude délimitée dans l’accord de servitude intitulé « Treaty Land Entitlement Replacement Easement Agreement for Electrical Transmission & Fibre Optic Cable Line Right-of-Way » conclu entre Sa Majesté du chef du Canada et la Saskatchewan Power Corporation pour les besoins d’une ligne de transport d’électricité et d’une ligne de transmission par câbles de fibres optiques visant les terres, à la condition que la Saskatchewan Power Corporation renonce à la servitude en faveur de Sa Majesté du chef du Canada lorsqu’elle ne sera plus requise pour ces besoins;

b) en vertu du paragraphe 35(3) de la Loi sur les Indiens, au lieu que la Saskatchewan Power Corporation prenne la servitude faisant l’objet du consentement prévu à l’alinéa a), permet l’octroi à la Saskatchewan Power Corporation de la servitude délimitée dans l’accord de servitude intitulé « Treaty Land Entitlement Replacement Easement Agreement for Electrical Transmission & Fibre Optic Cable Line Right-of-Way » conclu entre Sa Majesté du chef du Canada et la Saskatchewan Power Corporation pour les besoins d’une ligne de transport d’électricité et d’une ligne de transmission par câbles de fibres optiques visant les terres, à la condition que la Saskatchewan Power Corporation renonce à la servitude en faveur de Sa Majesté du chef du Canada lorsqu’elle ne sera plus requise pour ces besoins.

Firstly:

The most Westerly Thirty (30) feet in perpendicular width throughout of Surface Parcel No. 145011855, being that portion of the North East Quarter and the South East Quarter of Section 8, Township 17, Range 19, West of the Second Meridian, Saskatchewan, shown as Block B, on the Plan of record in the Canada Lands Surveys Records as No. 91099 and in the Saskatchewan Land Surveys Directory as No. 99RA08587, as amended by Master of Titles Order 01RA01057, containing

13.153 hectares (32.5 acres) more or less.

La bande de terrain la plus à l’ouest d’une largeur constante de trente (30) pieds perpendiculairement dans la surface n^o 145011855, soit la partie des quarts nord-est et sud-est de la section 8, dans le canton 17, dans le rang 19, à l’ouest du deuxième méridien, en Saskatchewan, représentée comme le bloc B sur le plan n^o 91099 des Archives d’arpentage des terres du Canada et sur le plan n^o 99RA08587 du répertoire des levés officiels de la Saskatchewan, tel que modifié par l’arrêté n^o 01RA01057 du conservateur des titres et ayant une superficie de 13,153 hectares (32,50 acres), plus ou moins.
