Her Excellency the Governor General in Council, on the recommendation of the Minister of Health, makes the annexed Canadian Thalidomide Survivors Support Program Order.

Definitions

   

1 The following definitions apply in this Order.

extraordinary medical assistance fund means the fund that is established under subsection 2‍(2) of this Order. (fonds d’aide médicale extraordinaire)

Minister means the Minister of Health. (ministre)

Program means the Canadian Thalidomide Survivors Support Program that is established by this Order. (Programme)

third-party administrator means an entity with which the Minister has entered into an agreement for the purposes of administering the Program. (tiers administrateur)

   

 

     

 

Authorization

   

 

     

 

     

 

Ex gratia payment

   

2(1) The Minister is authorized under the Program to make an ex gratia payment to any person who is determined to be eligible under the Program.

   

 

Extraordinary medical assistance fund

   

(2) The Minister is authorized under the Program to establish an ex gratia extraordinary medical assistance fund to defray extraordinary health support costs such as specialized surgery and home or vehicle adaptations that are not otherwise provided for in provincial or territorial health care plans.

   

 

     

 

Eligibility

   

 

     

 

     

 

Conditions

   

3(1) Any person who meets any of the following conditions is eligible under the Program:

(a) they were determined to be eligible under the 1991 Extraordinary Assistance Plan for victims of thalidomide or under the Thalidomide Survivors Contribution Program (2015);

(b) they were not determined to be eligible under the 1991 Extraordinary Assistance Plan for victims of thalidomide or under the Thalidomide Survivors Contribution Program (2015) but they are listed on a Canadian government registry for thalidomide victims and that registry exists on the day on which this Order is made; or

(c) they are determined by the third-party administrator to be eligible.

   

 

Automatic eligibility

   

(2) Any person referred to in paragraph (1)‍(a) is automatically eligible under the Program without the need to submit an application.

   

 

Registration

   

(3) Any person referred to in paragraph (1)‍(b) must register for the Program with the third-party administrator, who will confirm the person’s eligibility after verifying the person’s identity.

   

 

Application

   

(4) Any person who wishes to be determined to be eligible under the Program under paragraph (1)‍(c) must, within five years after the day on which the Program begins, submit to the third-party administrator an application in the form and manner specified by the third-party administrator.

   

 

Third-party administrator

   

(5) For the purposes of paragraph (1)‍(c), the third-party administrator must determine whether a person is eligible under the Program by using the following three-step process:

(a) it must conduct a preliminary assessment of the person’s eligibility based on the following criteria:

(i) the date of birth of the person in Canada falls within the period beginning on December 3, 1957 and ending on December 21, 1967,

(ii) the person’s date of birth or any other information available is consistent with maternal ingestion of thalidomide in the first trimester of pregnancy, and

(iii) the nature of the person’s congenital malformations is consistent with known characteristics of congenital malformations linked to thalidomide;

(b) if the third party administrator considers that it is likely, based on the preliminary assessment, that the person’s congenital malformations are the result of maternal ingestion of thalidomide in the first trimester of pregnancy, it must assess the probability that the person’s congenital malformations are consistent with known patterns of thalidomide embryopathy using a diagnostic algorithm for thalidomide embryopathy that it has selected; and

(c) if the diagnostic algorithm for thalidomide embryopathy shows that it is probable that the person’s congenital malformations are consistent with known patterns of thalidomide embryopathy, the third-party administrator must refer the person’s application to a multi-disciplinary committee of medical and legal experts that it has selected, and the committee must provide the third-party administrator with its recommendation on whether the person should be eligible under the Program.

   

 

Algorithm result

   

(6) For the purposes of paragraph (5)‍(c), the term “probable” is the highest point on the three-point scale of the diagnostic algorithm for thalidomide embryopathy.

   

 

Review by the committee

   

(7) For the purposes of paragraph (5)‍(c), the multi-disciplinary committee must base its recommendation on the totality of the information related to the application and any other evidence that it considers to be relevant, including any genetic test results and medical exams it may requisition.

   

 

     

 

Payment

   

 

     

 

     

 

Person referred to in paragraph 3‍(1)‍(a)

   

4 Any person referred to in paragraph 3‍(1)‍(a) is to receive, from the day on which the Program begins,

(a) a tax-free lump-sum payment of $125,000;

(b) the annual payment amount set out in the schedule, which is based on the level of disability that was determined under the Thalidomide Survivors Contribution Program (2015) and which is tax-free; and

(c) access to the extraordinary medical assistance fund.

   

 

Person referred to in paragraph 3‍(1)‍(b) or (c)

   

5 Any person referred to in paragraph 3‍(1)‍(b) or (c) is to receive

(a) a tax-free lump-sum payment of $250,000;

(b) the annual payment amount set out in the schedule, which is based on the level of disability that is determined by the third-party administrator and which is tax-free and paid

(i) in the case of a person referred to in 3‍(1)‍(b), from the day on which the duly completed registration is submitted to the Program, and

(ii) in the case of a person referred to in paragraph 3‍(1)‍(c), from the day on which the duly completed application is submitted to the Program; and

(c) access to the extraordinary medical assistance fund, from the day on which they are determined to be eligible under the Program.

6 Any payment made under this Order is not to be construed as an admission of liability on the part of the Crown.

Paiement à titre gracieux

   

2(1) Le ministre est autorisé à faire un paiement à titre gracieux, au titre du Programme, à toute personne qui est admise au Programme.

 

 

   

Fonds d’aide médicale extraordinaire

   

(2) Le ministre est autorisé à établir à titre gracieux, au titre du Programme, un fonds d’aide médicale extraordinaire destiné à défrayer les coûts liés à des soins de santé extraordinaires, tels qu’une chirurgie spécialisée ou l’adaptation d’une résidence ou d’un véhicule, qui ne sont pas couverts par le régime de soins de santé provincial ou territorial.

 

 

     

 

   

Admissibilité

 

 

     

 

     

 

   

Conditions

   

3(1) Toute personne qui répond à l’une ou l’autre des conditions ci-après est admissible au Programme :

a) elle a été jugée admissible au Régime d’aide extraordinaire de 1991 pour les victimes de la thalidomide ou au Programme de contribution pour les survivants de la thalidomide (2015);

b) elle n’a pas été jugée admissible au Régime d’aide extraordinaire de 1991 pour les victimes de la thalidomide ou au Programme de contribution pour les survivants de la thalidomide (2015), mais son nom figure dans un registre gouvernemental canadien de victimes de la thalidomide existant à la date de prise du présent décret;

c) elle est jugée admissible par le tiers administrateur.

 

 

   

Admissibilité d’office

   

(2) La personne visée à l’alinéa (1)a) est admissible d’office au Programme et, à ce titre, elle n’est pas tenue de présenter une demande.

 

 

   

Inscription au Programme

   

(3) La personne visée à l’alinéa (1)b) doit s’inscrire au Programme auprès du tiers administrateur, qui confirme son admissibilité après avoir vérifié son identité.

 

 

   

Demande d’admissibilité au Programme

   

(4) La personne qui souhaite être jugée admissible au Programme en application de l’alinéa (1)c) présente au tiers administrateur, dans les cinq ans suivant la date de début du Programme, une demande en la forme et de la manière fixées par celui-ci.

 

 

   

Tiers administrateur

   

(5) Pour l’application de l’alinéa (1)c), le tiers administrateur juge si une personne est admissible au Programme en suivant les trois étapes suivantes :

a) il effectue une évaluation préliminaire de l’admissibilité de la personne en se fondant sur les critères suivants :

(i) la date de naissance de la personne au Canada tombe durant la période débutant le 3 décembre 1957 et se terminant le 21 décembre 1967,

(ii) sa date de naissance ou tout autre renseignement disponible concorde avec la prise de thalidomide par sa mère au cours du premier trimestre de grossesse,

(iii) la nature de ses malformations congénitales concorde avec les caractéristiques connues des malformations congénitales liées à la thalidomide;

b) s’il est d’avis qu’il est vraisemblable, selon l’évaluation préliminaire, que les malformations congénitales de la personne découlent de la prise de thalidomide par sa mère au cours du premier trimestre de grossesse, il évalue la probabilité que celles-ci concordent avec l’ensemble des caractéristiques connues de l’embryopathie due à la thalidomide au moyen d’un algorithme de diagnostic de l’embryopathie due à la thalidomide qu’il choisit;

c) si l’algorithme de diagnostic de l’embryopathie due à la thalidomide démontre qu’il est probable que les malformations congénitales de la personne concordent avec l’ensemble des caractéristiques connues de l’embryopathie due à la thalidomide, il transmet la demande à un comité multidisciplinaire d’experts des domaines médical et juridique, formé des membres qu’il choisit, pour que celui-ci lui fasse une recommandation quant à l’admissibilité de la personne au Programme.

 

 

   

Résultat de l’algorithme

   

(6) Pour l’application de l’alinéa (5)c), « ‍probable‍ » est la cote la plus élevée sur l’échelle de l’algorithme de diagnostic de l’embryopathie due à la thalidomide, laquelle compte trois cotes.

 

 

   

Examen par le comité

   

(7) Pour l’application de l’alinéa (5)c), le comité multidisciplinaire fonde sa recommandation sur l’ensemble des renseignements relatifs à la demande et sur toute autre donnée qu’il juge pertinente, notamment les résultats des analyses génétiques et des examens médicaux qu’il peut demander.

 

 

     

 

   

Paiement

 

 

     

 

     

 

   

Personne visée à l’alinéa 3‍(1)a)

   

4 La personne visée à l’alinéa 3‍(1)a) reçoit, à compter de la date de début du Programme :

a) un paiement forfaitaire de 125 000 $, lequel montant est exempt d’impôt;

b) le montant annuel prévu à l’annexe, selon son niveau d’invalidité déterminé aux termes du Programme de contribution pour les survivants de la thalidomide (2015), lequel montant est exempt d’impôt;

c) un accès au fonds d’aide médicale extraordinaire.

 

 

   

Personne visée aux alinéas 3‍(1)b) ou c)

   

5 La personne visée aux alinéas 3‍(1)b) ou c) reçoit :

a) un paiement forfaitaire de 250 000 $, lequel montant est exempt d’impôt;

b) le montant annuel prévu à l’annexe, selon son niveau d’invalidité déterminé par le tiers administrateur, lequel montant est exempt d’impôt et est payé :

(i) dans le cas d’une personne visée à l’alinéa 3‍(1)b), à compter de la date de présentation de la demande d’inscription au Programme dûment remplie,

(ii) dans le cas d’une personne visée à l’alinéa 3‍(1)c), à compter de la date de présentation de la demande dûment remplie;

c) à compter de la date à laquelle elle est admise au Programme, un accès au fonds d’aide médicale extraordinaire.
