Whereas the Honourable David D. Smith, Chief Justice of the Court of Queen’s Bench of New Brunswick, will attain the age of seventy-five years on March 20, 2019, and, therefore, will cease to hold office on that date pursuant to subsection 99(2) of the Constitution Act, 1867;

And whereas the Honourable David D. Smith has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, grants to the Honourable David D. Smith an annuity of $235,066.66, commencing on March 20, 2019 and continuing during his life.

Attendu que l’honorable David D. Smith, juge en chef de la Cour du Banc de la Reine du Nouveau-Brunswick, atteindra l’âge de soixante-quinze ans le 20 mars 2019 et que, en conséquence, il cessera d’occuper sa charge à cette date en vertu du paragraphe 99(2) de la Loi constitutionnelle de 1867;

Attendu que l’honorable David D. Smith a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable David D. Smith une pension viagère annuelle de 235 066,66 $, payable à compter du 20 mars 2019.
