Her Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 67 of the Constitution Act, 1867, appoints the following person to be Administrator of the Government of Ontario, in order to execute the office and functions of the Lieutenant Governor of Ontario during that Lieutenant Governor’s absence, illness or other inability:
(a) the Chief Justice of Ontario;
(b) in the event of the absence, illness or other inability of the person referred to in paragraph (a) and only in respect of the days on which that person is absent, ill or otherwise unable, the Chief Justice of the Superior Court of Justice of Ontario;
(c) in the event of the absence, illness or other inability of both of the persons referred to in paragraphs (a) and (b) and only in respect of the days on which both of those persons are absent, ill or otherwise unable, the Associate Chief Justice of Ontario;
(d) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (c) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the Associate Chief Justice of the Superior Court of Justice of Ontario;
(e) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (d) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario with the most seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;

(f) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (e) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is second in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(g) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (f) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is third in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(h) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (g) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is fourth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(i) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (h) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is fifth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;

(j) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (i) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is sixth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(k) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (j) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is seventh in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(l) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (k) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is eighth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867;
(m) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (l) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is ninth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867; and

(n) in the event of the absence, illness or other inability of all of the persons referred to in paragraphs (a) to (m) and only in respect of the days on which all of those persons are absent, ill or otherwise unable, the judge of the Court of Appeal for Ontario who is tenth in seniority based on the date that the judge took the Oaths of Allegiance and Office referred to in section 61 of the Constitution Act, 1867.
Sur recommandation de la ministre du Patrimoine canadien et en vertu de l’article 67 de la Loi constitutionnelle de 1867, Son Excellence la Gouverneure générale en conseil nomme, à titre d’administrateur du gouvernement de l’Ontario, pour remplir les fonctions du lieutenant-gouverneur de cette province durant l’absence, la maladie ou autre incapacité de ce dernier :

c) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéa a) et b) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge en chef adjoint de l’Ontario;
d) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéa a) à c) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge en chef adjoint de la Cour supérieure de justice de l’Ontario;
e) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à d) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario cumulant le plus d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;

f) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à e) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au second rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
g) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à f) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au troisième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
h) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à g) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au quatrième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
i) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à h) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au cinquième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;

j) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à i) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au sixième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
k) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à j) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au septième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
l) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à k) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au huitième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
m) en cas d’absence, de maladie ou autre incapacité des juges visés aux alinéas a) à l) et seulement durant les jours d’absence, de maladie ou d’incapacité de ces derniers, le juge de la Cour d’appel de l’Ontario qui est au neuvième rang selon l’ordre d’ancienneté à compter de la date où il a prêté les serments d’allégeance et d’office visés à l’article 61 de la Loi constitutionnelle de 1867;
