Whereas, pursuant to subsection 157(3) of the Canada Labour Code, regulations of the Governor in Council under subsection 157(1) or (1.1) of that Act are to be made in respect of occupational safety and health of employees employed on ships, trains or aircraft, while in operation, on the recommendation of the Minister of Labour and the Minister of Transport and are to be made in respect of occupational safety and health of employees employed on or in connection with exploration or drilling for or the production, conservation, processing or transportation of oil or gas in frontier lands, as defined in the Canada Petroleum Resources Act, on the recommendation of the Minister of Labour, the Minister of Indian Affairs and Northern Development and the Minister of Natural Resources, the latter taking into consideration any recommendations made by the National Energy Board in relation to the regulations;

And whereas the National Energy Board has not made any recommendation in relation to the regulations;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Labour, the Minister of Transport, the Minister of Indian Affairs and Northern Development and the Minister of Natural Resources, pursuant to sections 125, 125.1, 126, 135.2 and 157 of the Canada Labour Code, makes the annexed Regulations Amending Certain Regulations Made Under the Canada Labour Code.

Attendu que, en vertu du paragraphe 157(3) du Code canadien du travail, les règlements du gouverneur en conseil prévus aux paragraphes 157(1) ou (1.1) de cette loi en matière de sécurité et de santé au travail se prennent, dans le cas d’employés travaillant à bord de navires, d’aéronefs ou de trains, en service, sur la recommandation de la ministre du Travail et du ministre des Transports et, dans le cas d’employés travaillant dans les secteurs de l’exploration et du forage pour la recherche de pétrole et de gaz sur les terres domaniales — au sens de la Loi fédérale sur les hydrocarbures — ou de la production, de la conservation, du traitement ou du transport de ce pétrole ou gaz, sur la recommandation, d’une part, de la ministre du Travail et de la ministre des Affaires indiennes et du Nord canadien et, d’autre part, du ministre des Ressources naturelles, celui-ci devant tenir compte des éventuelles recommandations de l’Office national de l’énergie à leur égard;

Attendu que l’Office national de l’énergie n’a formulé aucune recommandation à leur égard,

À ces causes, sur recommandation de la ministre du Travail, du ministre des Transports, de la ministre des Affaires indiennes et du Nord canadien et du ministre des Ressources naturelles et en vertu des articles 125, 125.1, 126, 135.2 et 157 du Code canadien du travail, Son Excellence le Gouverneur général en conseil prend le Règlement modifiant certains règlements pris en vertu du Code canadien du travail, ci-après.
