Whereas the First Nation of Montagnais de Unamen Shipu is a band within the meaning of the Indian Act (the Band);

 

Whereas on October 4, 2000, by Provincial Order
No. 1190-2000, Quebec transferred to Canada the usufruct of Quebec Crown lands described in the attached schedule, for the use and benefit of the Band as an addition to Romaine Indian Reserve No. 2;

 

Whereas on February 20, 2008, under section 5(2) of the Federal Real Property Regulations, Canada accepted the transfer of the usufruct of the lands for the use and benefit of the Band;

 

Whereas since the date of acceptance of the transfer, the Band has always occupied the lands and Canada has consistently treated the lands as a reserve and has administered them in accordance with the Indian Act;

 

And whereas, other than the acceptance act signed on February 20, 2008, there is no known formal record to confirm that the lands were set apart for the use and benefit of the Band, Canada wishes to establish a clear record and confirm the status of the lands since February 20, 2008;

 

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, confirms that the lands described in the attached schedule, consisting of 27.679 hectares (68.396 acres), excluding mines and minerals, have been set apart for the use and benefit of the First Nation of Montagnais de Unamen Shipu as Romaine Indian Reserve No. 2, in Quebec, since February 20, 2008, and continue to be set apart for the Band for that purpose.


 

Attendu que la Première Nation des Montagnais de Unamen Shipu est une bande au sens de la Loi sur les Indiens (la bande);

Attendu que le 4 octobre 2000, aux termes du décret provincial no 1190-2000, le Québec a transféré au Canada l’usufruit des terres de la Couronne du Québec, délimitées à l’annexe ci-jointe, à l’usage et au profit de la bande, à titre d’ajout à la réserve indienne Romaine no 2;

Attendu que le 20 février 2008, en vertu du paragraphe 5(2) du Règlement concernant les immeubles fédéraux, le Canada a accepté le transfert de l’usufruit de ces terres, à l’usage et au profit de la bande;

Attendu que depuis la date d’acceptation du transfert la bande a toujours occupé les terres et le Canada les a toujours traitées comme une réserve, conformément à la Loi sur les Indiens;

Attendu que le Canada, vu l’absence d’un document officiel attestant que ces terres ont été mises de côté à l’usage et au profit de la bande, autre que l’acte d’acceptation signé le 20 février 2008, souhaite constater dans un document officiel leur statut depuis le 20 février 2008,

À ces causes, sur recommandation de la ministre des Affaires indiennes et du Nord canadien, Son Excellence le Gouverneur général en conseil confirme que les terres délimitées à l’annexe ci-jointe, lesquelles sont constituées de 27,679 hectares (68,396 acres), mines et minéraux exclus, ont été mises de côté à l’usage et au profit de la Première Nation des Montagnais de Unamen Shipu à titre de réserve indienne Romaine no 2, au Québec, depuis le 20 février 2008 et demeurent mises de côté pour la bande à ces mêmes fins.

Secondly:

The whole of lot 176 Village-de-Grande-Romaine of the original survey of the Township of La Gorgendière, Province of Quebec, as shown on the plan No. 76331 CLSR, recorded in the Canada Lands Surveys Records and also known and designated as lot 176 Village-de-Grande-Romaine in the cadastre of Township of La Gorgendière, in the Registry Division of Sept-Îles, containing 4.826 hectares (11.925 acres), more or less;

 

Thirdly:

The whole of lot 177 Village-de-Grande-Romaine of the original survey of the Township of La Gorgendière, Province of Quebec, as shown on the plan No. 76331 CLSR, recorded in the Canada Lands Surveys Records and also known and designated as lot 177 Village-de-Grande-Romaine in the cadastre of Township of La Gorgendière, in the Registry Division of Sept-Îles, containing 0.2646 hectare (0.6538 acre), more or less;

 

Fourthly:

The whole of lot 178 Village-de-Grande-Romaine of the original survey of the Township of La Gorgendière, Province of Quebec, as shown on the plan No. 76331 CLSR, recorded in the Canada Lands Surveys Records and also known and designated as lot 178 Village-de-Grande-Romaine in the cadastre of Township of La Gorgendière, in the Registry Division of Sept-Îles, containing 10.422 hectares (25.753 acres), more or less;
