Whereas by Order in Council P.C. 2013-809 of June 13, 2013 as amended by Order in Council P.C. 2013-838 of June 21, 2013, Raj Shoan was appointed as a full-time member of the Canadian Radio-television and Telecommunications Commission (CRTC) for the Ontario region, to hold office during good behaviour for a term of five years, effective July 3, 2013;  

 

Whereas on February 26, 2016, the Minister of Canadian Heritage wrote to Raj Shoan informing him that certain of his actions brought to her attention called into question his capacity to continue serving as a Commissioner of the CRTC, providing him with information regarding these concerns including the documentation upon which they were based, and inviting him to make any representations that he wished to have taken into account before any decision was made on whether to terminate his appointment for cause;

 

Whereas the Governor in Council has carefully considered the February 26, 2016 correspondence sent by the Minister, as well as the material communicated to Raj Shoan with that correspondence, the submissions made by Raj Shoan on March 14, 2016 and the material enclosed with those submissions;

 

Whereas, in light of the September 2, 2016 decision of Mr. Justice Zinn of the Federal Court in the matter of Shoan v. Canada (Attorney General), docket T-668-15, the Governor in Council has excluded from consideration the report into the complaint of harassment filed against Raj Shoan on March 17, 2015 and the sole grounds on which the Governor in Council relies are set out below;

Whereas the Governor in Council has concluded that Raj Shoan’s actions with respect to inappropriate contact with CRTC stakeholders and his lack of recognition of and disregard for the impact of that contact on the reputation and integrity of the CRTC (the inappropriate contact ground) are fundamentally incompatible with his position and that he no longer enjoys the confidence of the Governor in Council to be a Commissioner of the CRTC;

 

And whereas, independent of the inappropriate contact ground, the Governor in Council has concluded that Raj Shoan’s responses related to his refusal to respect internal CRTC processes and practices for meeting its obligations under the Access to Information Act and his negative public statements about the CRTC are fundamentally incompatible with his position and that he no longer enjoys the confidence of the Governor in Council to be a Commissioner of the CRTC;

 

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister for the purposes of the Canadian Radio-television and Telecommunications Commission Act, pursuant to subsection 3(2) of the Canadian Radio-television and Telecommunications Commission Act, terminates for cause the appointment of Raj Shoan as a full-time member of the Canadian Radio-television and Telecommunications Commission for the Ontario region, effective May 5, 2017.  

 

 

 

 


 

 

 

 

 

 

 

 

 

 

Attendu que, par le décret C.P. 2013-809 du 13 juin 2013, modifié par le décret C.P. 2013-838 du 21 juin 2013, Raj Shoan a été nommé conseiller à temps plein du Conseil de la radiodiffusion et des télécommunications canadiennes (CRTC) pour la région de l’Ontario à titre inamovible pour un mandat de cinq ans, à compter du 3 juillet 2013;

 

Attendu que le 26 février 2016, la ministre du Patrimoine canadien a écrit à Raj Shoan pour l’informer que certaines des actions de ce dernier qui ont été rapportées à la ministre remettent en question sa capacité d’agir en tant que commissaire du CRTC, qu’elle lui a fourni également les renseignements relatifs à ces préoccupations, y compris la documentation sur laquelle ces dernières sont fondées, et qu’elle l’a invité à faire toute observation qu’il voulait qu’elle prenne en considération avant qu’une décision soit prise en ce qui a trait à la révocation de sa nomination pour un motif valable;

 

Attendu que le gouverneur en conseil a examiné attentivement la correspondance envoyée le 26 février 2016 par la ministre, les documents communiqués à Raj Shoan dans cette correspondance, les représentations faites par Raj Shoan le14 mars 2016 et les documents accompagnant ces représentations;

 

Attendu qu'à la lumière de la décision du 2 septembre 2016 de M. le juge Zinn de la Cour fédérale dans l’affaire Shoan c. Canada (Procureur général), numéro de dossier T-668-15, le Gouverneur en conseil a exclu de son examen le rapport concernant la plainte de harcèlement déposée le 17 mars 2015 contre Raj Shoan et que les seuls motifs sur lesquels s’appuie le Gouverneur en conseil sont énoncés ci-après;

Attendu que le gouverneur en conseil a conclu que les échanges inappropriés entre Raj Shoan et des intervenants auprès du CRTC ainsi que sa dénégation de l’effet de ces échanges sur la réputation et l’intégrité du CRTC (motif des échanges inappropriés) sont fondamentalement incompatibles avec ses fonctions et qu’il n’a plus la confiance du gouverneur en conseil pour agir à titre de commissaire du CRTC;

 

Attendu que le gouverneur en conseil a conclu que, abstraction faite du motif des échanges inappropriés, les réponses de Raj Shoan quant à son refus de respecter les processus et les pratiques internes du CRTC pour remplir ses obligations aux termes de la Loi sur l’accès à l’information et quant à ses déclarations publiques négatives concernant le CRTC sont fondamentalement incompatibles avec ses fonctions et qu’il n’a plus la confiance du gouverneur en conseil pour agir à titre de commissaire du CRTC,

 

À ces causes, sur recommandation de la ministre aux fins de l’application de la Loi sur le Conseil de la radiodiffusion et des télécommunications canadiennes et en vertu du paragraphe 3(2) de la Loi sur le Conseil de la radiodiffusion et des télécommunications canadiennes, Son Excellence le Gouverneur général en conseil met fin, pour un motif valable, à la nomination de Raj Shoan à titre de membre à temps plein du Conseil de la radiodiffusion et des télécommunications canadiennes pour la région de l’Ontario, à compter du 5 mai 2017.
