Whereas, on July 23, 2016, 14 years had elapsed since the establishment of a list by the Regulations Establishing a List of Entities pursuant to subsection 83.05(1) of the Criminal Code;

Whereas, pursuant to subsection 83.05(9) of the Criminal Code, the Minister of Public Safety and Emergency Preparedness has reviewed that list, as it existed on July 23, 2016, and has determined that there are no longer reasonable grounds to believe that each entity referred to in subsection 1(1) of the annexed Regulations Amending the Regulations Establishing a List of Entities has knowingly carried out, attempted to carry out, participated in or facilitated a terrorist activity or is knowingly acting on behalf of, at the direction of or in association with such an entity;

And whereas, pursuant to subsection 83.05(1) of the Criminal Code, the Governor in Council is satisfied, on the recommendation of the Minister of Public Safety and Emergency Preparedness, that there are reasonable grounds to believe that each entity referred to in subsection 1(2) of the annexed Regulations Amending the Regulations Establishing a List of Entities has knowingly carried out, attempted to carry out, participated in or facilitated a terrorist activity or is knowingly acting on behalf of, at the direction of or in association with such an entity;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Public Safety and Emergency Preparedness,

(a) accepts the recommendation of the Minister of Public Safety and Emergency Preparedness, made pursuant to subsection 83.05(9) of the Criminal Code, that each entity listed on July 23, 2016, other than those referred to in subsection 1(1) of the annexed Regulations Amending the Regulations Establishing a List of Entities, remain a listed entity; and

(b) pursuant to subsection 83.05(1) of the Criminal Code, makes the annexed Regulations Amending the Regulations Establishing a List of Entities.

Attendu que, le 23 juillet 2016, quatorze ans s’étaient écoulés depuis l’établissement d’une liste par le Règlement établissant une liste d’entités, en vertu du paragraphe 83.05(1) du Code criminel;

Attendu que, aux termes du paragraphe 83.05(9) du Code criminel, le ministre de la Sécurité publique et de la Protection civile a examiné cette liste, telle qu’elle existait au 23 juillet 2016, et a conclu qu’il n’existe plus de motifs raisonnables de croire que chacune des entités visées au paragraphe 1(1) du Règlement modifiant le Règlement établissant une liste d’entités, ci-après, est une entité qui, sciemment, s’est livrée ou a tenté de se livrer à une activité terroriste, y a participé ou l’a facilitée, ou qui, sciemment, agit au nom d’une telle entité, sous sa direction ou en collaboration avec elle;

Attendu que, aux termes du paragraphe 83.05(1) du Code criminel, le gouverneur en conseil est convaincu, sur recommandation du ministre de la Sécurité publique et de la Protection civile, qu’il existe des motifs raisonnables de croire que chacune des entités visées au paragraphe 1(2) du Règlement modifiant le Règlement établissant une liste d’entités, ci-après, est une entité qui, sciemment, s’est livrée ou a tenté de se livrer à une activité terroriste, y a participé ou l’a facilitée, ou qui, sciemment, agit au nom d’une telle entité, sous sa direction ou en collaboration avec elle,

À ces causes, Son Excellence le Gouverneur général en conseil, sur recommandation du ministre de la Sécurité publique et de la Protection civile :

a) accepte la recommandation de celui-ci, faite conformément au paragraphe 83.05(9) du Code criminel, que chaque entité figurant sur la liste au 23 juillet 2016 y demeure inscrite, à l’exception des entités visées au paragraphe 1(1) du Règlement modifiant le Règlement établissant une liste d’entités, ci-après;

b) prend, en vertu du paragraphe 83.05(1) du Code criminel, le Règlement modifiant le Règlement établissant une liste d’entités, ci-après.
