Whereas the Honourable Kevin W. Whitaker, a Judge of the Superior Court of Justice in and for the Province of Ontario, has become afflicted with a permanent infirmity disabling him from the due execution of his office and has tendered his resignation;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Justice,

(a) accepts the resignation of the Honourable Kevin W. Whitaker; and

(b) pursuant to paragraph 42(1)(c) of the Judges Act, grants to the Honourable Kevin W. Whitaker an annuity of $209,400, commencing on the date of the making of this Order and continuing during his life.

Attendu que l’honorable Kevin W. Whitaker, juge de la Cour supérieure de justice de l’Ontario, a donné sa démission pour incapacité par suite d’une infirmité permanente,

À ces causes, sur recommandation de la ministre de la Justice, Son Excellence le Gouverneur général en conseil :

a) accepte la démission de l’honorable Kevin W. Whitaker;

b) en vertu de l’alinéa 42(1)c) de la Loi sur les juges, accorde à l’honorable Kevin W. Whitaker, à titre viager, une pension annuelle de 209 400 $, payable à compter de la date de prise du présent décret.
