Whereas a band council election was held for one chief and twelve councillors in the Esgenoôpetitj First Nation, in New Brunswick, on June 14, 2014;

Whereas, pursuant to subsection 12(1) of the Indian Band Election Regulations, the election was appealed;

Whereas the Minister of Indian Affairs and Northern Development has reported that, following a review of all particulars and documents filed in connection with the appeal, which included a report prepared by an independent investigator, it appears that there is credible, corroborated evidence that several candidates engaged in vote buying in connection with this election;

Whereas the Minister of Indian Affairs and Northern Development has reported, in accordance with paragraph 14(a) of the Indian Band Election Regulations, that, based on the above findings, she is satisfied that there was corrupt practice in connection with the election;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development and pursuant to paragraph 79(a) of the Indian Act, sets aside the election, held on June 14, 2014, of Alvery Paul to the position of chief, and Joseph Bartibogue, Joseph Bonnell, Derek Dedam, Mark Simon, Carrie Dedam, Sheila Francis, Pernell Bonnell, Clark Dedam, Calvin Barnaby, Billy Francis, Mary Richardson and Frances Joe to the positions of councillor on the council of the Esgenoôpetitj First Nation.

Attendu qu’une élection du conseil de bande a été tenue pour le choix d’un chef et de douze conseillers dans la Première Nation Esgenoôpetitj, au Nouveau-Brunswick, le 14 juin 2014;

Attendu que cette élection a fait l’objet d’un appel interjeté en vertu du paragraphe 12(1) du Règlement sur les élections au sein des bandes d’Indiens;

Attendu que la ministre des Affaires indiennes et du Nord canadien, après avoir examiné tous les détails et toutes les pièces déposés dans le cadre de l’appel, y compris un rapport établi par un enquêteur indépendant, a indiqué dans son rapport qu’il y a lieu de croire au vue de preuves crédibles et corroborées, que plusieurs candidats ont participé à l’achat de vote en rapport à cette élection;
