                      Whereas the Canadian Radio-television and Telecommunications Commission rendered Broadcasting Decision CRTC 2003-115 on April 17, 2003, which approved the application by 3885275 Canada Inc., carrying on business as Canadian Multicultural Radio, for a broadcasting licence for an ethnic FM radio station in Toronto operating at a frequency of 101.3 MHz;

                      Whereas the Governor in Council received petitions requesting that the Decision be set aside or referred back to the Commission for reconsideration and hearing of the matter;

                      And whereas the Governor in Council is not satisfied that the Decision derogates from the attainment of the objectives of the broadcasting policy set out in subsection 3(1) of the Broadcasting Act;

                      Therefore, Her Excellency the Governor General in Council, on the recommendation of the Acting Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, hereby declines to set aside or refer back to the Commission for reconsideration and hearing Broadcasting Decision CRTC 2003-115 of April 17, 2003.

                      Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes a, dans sa décision de radiodiffusion CRTC 2003-115 du 17 avril 2003, approuvé la demande présentée par 3885275 Canada Inc., faisant affaire sous le nom de Canadian Multicultural Radio, en vue d'obtenir une licence de radiodiffusion pour exploiter, à Toronto, une station de radio FM à caractère ethnique à la fréquence

101,3 MHz;

                      Attendu que la gouverneure en conseil a reçu des demandes requérant l'annulation de la décision ou son renvoi au Conseil pour réexamen et nouvelle audience;

                      Attendu que la gouverneure en conseil n'est pas convaincue que cette décision ne va pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la

Loi sur la radiodiffusion,

                      À ces causes, sur recommandation de la ministre suppléante du Patrimoine canadien et en vertu de l'article 28 de la Loi sur la radiodiffusion, Son Excellence la Gouverneure générale en conseil refuse d'annuler ou de renvoyer la décision de radiodiffusion CRTC 2003-115 du 17 avril 2003 au Conseil pour réexamen et nouvelle audience.
