Whereas the Canadian Radio-television and Telecommunications Commission (“the Commission”), in its Broadcasting Decision CRTC 2015-483 of October 28, 2015, approved the application by Corus Entertainment Inc., on behalf of OWN Inc., to amend the broadcasting licence for the national English-language specialty Category A service OWN: The Oprah Winfrey Network, specifically concerning conditions of licence that relate to OWN: The Oprah Winfrey Network’s nature of service and adherence to a terms of trade agreement;

Whereas, subsequent to the making of that decision, the Governor in Council received a petition in writing requesting that that decision be set aside or referred back to the Commission for reconsideration and hearing;

And whereas the Governor in Council, having considered the petition, is not satisfied that that decision derogates from the attainment of the objectives of the broadcasting policy for Canada set out in subsection 3(1) of the Broadcasting Act;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Canadian Heritage, pursuant to section 28 of the Broadcasting Act, declines to set aside or refer back to the Commission for reconsideration and hearing its Broadcasting Decision CRTC 2015-483 of October 28, 2015 approving the amendments to the broadcasting licence of Corus Entertainment Inc. for the national English-language specialty Category A service OWN: The Oprah Winfrey Network.

Attendu que le Conseil de la radiodiffusion et des télécommunications canadiennes (le « Conseil ») a, dans sa décision de radiodiffusion CRTC 2015-483 du 28 octobre 2015, approuvé la demande déposée par Corus Entertainment Inc., au nom de OWN Inc., en vue de modifier la licence de radiodiffusion du service national de catégorie A spécialisé de langue anglaise OWN : The Oprah Winfrey Network, spécifiquement en ce qui a trait à des conditions de licence portant sur la nature de service d’OWN : The Oprah Winfrey Network et sur le respect d’une entente commerciale;

Attendu que, à la suite de cette décision, le gouverneur en conseil a reçu une demande écrite requérant l’annulation de cette décision ou son renvoi au Conseil pour réexamen et nouvelle audience;

Attendu que le gouverneur en conseil, après avoir examiné la demande, n’est pas convaincu que cette décision ne va pas dans le sens des objectifs de la politique canadienne de radiodiffusion énoncés au paragraphe 3(1) de la Loi sur la radiodiffusion,

À ces causes, sur recommandation de la ministre du Patrimoine canadien et en vertu de l’article 28 de la Loi sur la radiodiffusion, Son Excellence le Gouverneur général en conseil refuse d’annuler ou de renvoyer au Conseil pour réexamen et nouvelle audience la décision de radiodiffusion CRTC 2015-483 du 28 octobre 2015 approuvant les modifications à la licence de radiodiffusion de Corus Entertainment Inc. pour le service national de catégorie A spécialisé de langue anglaise OWN : The Oprah Winfrey Network.
