His Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources, pursuant to subsection 21(2) of the National Energy Board Act, approves the issuance by the National Energy Board to NOVA Gas Transmission Ltd. of Amending Order AO-005-GC-113, substantially in the annexed form.

IN THE MATTER OF the National Energy Board Act 

(the Act) and the regulations made thereunder; and

 

IN THE MATTER OF the notification of the transfer of ownership from NOVA Gas Transmission Ltd. (NGTL) to Ember Resources Inc. (Ember) pursuant to subsection 21(2), filed with the National Energy Board under File OF-Fac-Gas-N081-2013-11 01

 

 

BEFORE the Board on 22 October 2013.

 

WHEREAS the Board issued Certificate of Public Convenience and Necessity (CPCN) GC-113 on 15 April 2009 to NGTL, authorising the operation of the TransCanada Alberta System, and CPCN GC-113 came into force on 29 April 2009;

 

AND WHEREAS the TransCanada Alberta System as described in Schedule A to CPCN GC-113 includes the Hackett Lateral and the Hackett Lateral Loop, and the Hackett Meter Station (the Facilities);

 

AND WHEREAS on 23 October 2013 the Board issued Order MO-043-2013 granting leave for NGTL to sell the Facilities to Ember;

 

AND WHEREAS on 23 October 2013 the Board issued Order AO-001-MO-043-2013 approving the disconnection of the Facilities from the TransCanada Alberta System;

 

AND WHEREAS the Board received confirmation, by letter from NGTL dated 21 November 2013, that the transaction had been completed;

 

AND WHEREAS the Board received confirmation by letter from NGTL dated 18 December 2013 that the Facilities were mechanically isolated from the TransCanada Alberta System on 22 November 2013 in accordance with AO-001-MO-043-2013;

 

AND WHEREAS the Board has determined, pursuant to section 20 of the Act, that it is just and proper to grant NGTL further relief, in addition to the relief applied for, to amend Schedule A of CPCN GC-113 to reflect the removal of the Hackett Lateral and Hackett Lateral Loop, and the Hackett Meter Station from the TransCanada Alberta System;

 

AND WHEREAS the Board has decided it is in the public interest to issue this Amending Order to effect the variance;

AND WHEREAS the Governor in Council by Order in Council No. P.C. _______ dated the ____day of _____ 2014, has approved the issuance of this Amending Order;

 

IT IS ORDERED THAT, pursuant to subsection 21(2) of the Act, Schedule A to CPCN GC-113 is hereby amended to reflect the removal of the Hackett Lateral and Hackett Lateral Loop, and the Hackett Meter Station from the TransCanada Alberta System.

RELATIVEMENT À la Loi sur l’Office national de l’énergie (la Loi) et à ses règlements d’application;

 

RELATIVEMENT À l’avis de transfert de propriété de NOVA Gas Transmission Limited (NGTL) à Ember Resources Inc. (Ember), déposé devant l’Office national de l’énergie (dossier OF-Fac-Gas-N081-2013-11 01).

 

DEVANT l’Office, le 22 octobre 2013.

 

ATTENDU QUE le 15 avril 2009, l’Office a délivré à NGTL le certificat d’utilité publique GC-113, ayant pour effet d’autoriser l’exploitation du réseau de l’Alberta de TransCanada, et que ce certificat est entré en vigueur le 29 avril 2009;

 

ATTENDU QUE le réseau de l’Alberta de TransCanada, tel qu’il est décrit à l’annexe A du certificat GC-113, inclut la canalisation latérale, le doublement latéral et la station de comptage Hackett (les installations);

 

ATTENDU QUE, le 23 octobre 2013, l’Office a rendu l’ordonnance MO-043-2013 autorisant NGTL à vendre les installations à Ember;

 

ATTENDU QUE, le 23 octobre 2013, l’Office a rendu l’ordonnance AO-001-MO-043-2013 autorisant le débranchement des installations du réseau de l’Alberta de TransCanada;

 

ATTENDU QUE l’Office a reçu la confirmation, par une lettre de NGTL datée du 21 novembre 2013, que la transaction avait eu lieu;

 

ATTENDU QUE l’Office a reçu la confirmation, par une lettre de NGTL datée du 18 décembre 2013, que les installations avaient été mécaniquement isolées du réseau de l’Alberta le 22 novembre 2013, conformément aux dispositions de l’ordonnance AO-001-MO-043-2013;

 

ATTENDU QUE l’Office a déterminé, en vertu de l’article 20 de la Loi, qu’il est juste et approprié, en plus d’acquiescer à la demande présentée, de modifier l’annexe A du certificat GC-113, afin qu’elle reflète le retrait de la canalisation latérale, du doublement latéral et de la station de comptage Hackett du réseau de l’Alberta de TransCanada;

 

ATTENDU QUE l’Office a décidé qu’il est dans l’intérêt public de rendre la présente ordonnance modificatrice pour donner effet à la modification;

ATTENDU QUE le gouverneur en conseil, au moyen du décret C.P. _______ daté du _________________ 2014, a approuvé la délivrance de l’ordonnance modificatrice;

 

IL EST ORDONNÉ QUE, en vertu du paragraphe 21(2) de la Loi, l’annexe A du certificat GC-113 soit par les présentes modifiée de manière à tenir compte du retrait de la canalisation latérale, du doublement latéral et de la station de comptage Hackett du réseau de l’Alberta de TransCanada.
