PC Number: 2013-0379

Date: 2013-04-18

Whereas on October 14, 2011, NOVA Gas Transmission Ltd. (NGTL) applied to the National Energy Board (Board) for a Certificate of Public Convenience and Necessity for the Northwest Mainline Komie North Extension (Project) under sections 52 and 58 Part III of the National Energy Board Act. The application was to extend the Komie North Section, including the Fortune Creek meter station, north of Fort Nelson, in British Columbia and to construct the Chinchaga Section northwest of Manning in Alberta;

Whereas the Chinchaga Section of the Project would be an expansion of portions of NGTL’s existing Alberta System in northwestern Alberta. The Chinchaga Section of the Project consists of approximately 33 km of 1,219 mm (48 inch) outside diameter pipe located approximately 76 km northwest of Manning, Alberta, paralleling NGTL’s existing Chinchaga Lateral Loop No. 3 from the existing Chinchaga Meter Station to a tie-in point at the existing Meikle River Compressor Station;

Whereas the Board conducted an oral public hearing in Fort Nelson, British Columbia, on October 10 and 11, 2012 and in Calgary, Alberta, from October 15 to 24, 2012;

Whereas the Board considered all evidence on the record pursuant to the requirements of the National Energy Board Act and its responsibilities pursuant to the National Energy Board Act relating to environmental and socio-economic matters;

Whereas the Board considered that NGTL’s Aboriginal engagement program was appropriate given the nature, scope and setting of the project, and is satisfied that all Aboriginal groups potentially affected by the project were provided with sufficient information about the Project and had an opportunity to make their views known to the Board;

Whereas the Board determined that with the implementation of NGTL’s environmental protection procedures and mitigation measures, and with compliance with the Board’s regulatory requirements and proposed conditions, the Project will not likely cause significant adverse environmental effects;

Whereas Certificate of Public Convenience and Necessity GC-121 would include a condition requiring NGTL to file Aboriginal Consultation Reports for five years to inform the Board about its ongoing consultation with Aboriginal groups;

Whereas the Board, in its Report dated January 30, 2013, submitted to the Minister of Natural Resources on January 30, 2013, determined that the section 52 facilities for the Chinchaga Section of the Project will be required by the present and future public convenience and necessity, and recommended that a certificate be issued for the Chinchaga Section subject to the twenty-five conditions contained in Appendix III of its Report;

Whereas the Board has concluded that approval of the Komie North Section of the Project, as proposed, would have negative commercial impacts on other parties and that the need for that Section is uncertain, and recommended that a certificate should not be issued for the Komie North Section;

Whereas the Board has nonetheless made the terms and conditions contained in Appendix IV in relation to the Komie North Section of the Project, as required by section 52 of the National Energy Board Act;

Whereas the Crown record, composed of the National Energy Board Report, the available material and information on the National Energy Board record, and other communications between the Crown and Aboriginal groups outside the National Energy Board process, indicates with regard to the Chinchaga Section of the Project:

1) that any potential impact on potential or established aboriginal and treaty rights is likely to be minimal; and

2) that any such impact would be appropriately accommodated by the proponent and through conditions attached to the certificate;

Whereas this Crown record indicates that the Crown’s legal duty to consult and accommodate, where appropriate, has been adequately fulfilled with regard to the Chinchaga Section of the Project;

And whereas, the Governor in Council is therefore of the view that the National Energy Board should be directed to issue a certificate for the Chinchaga portion of the Project only;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources, pursuant to section 54 of the National Energy Board Act, directs the National Energy Board to issue NOVA Gas Transmission Ltd. Certificate of Public Convenience and Necessity GC-121 for the Chinchaga section of the Northwest Mainline Komie North Extension project only, subject to the conditions contained in Appendix III of its Report dated January 30, 2013.

Attendu que le 14 octobre 2011, NOVA Gas Transmission Ltd. (NGTL) a présenté une demande de certificat d’utilité publique auprès de l’Office national de l’énergie (Office) pour le prolongement Komie Nord de la canalisation principale du nord-ouest (projet) en vertu des articles 52 et 58 de la partie III de la Loi sur l’Office national de l’énergie. La demande visait le prolongement du tronçon Komie Nord, y compris la station de comptage de Fortune Creek, au nord de Fort Nelson, en Colombie-Britannique, et la construction du tronçon Chinchaga au nord-ouest de Manning en Alberta;

Attendu que le tronçon Chinchaga du projet serait un agrandissement de parties du réseau de l’Alberta actuel de NGTL dans le nord-ouest de l’Alberta. Le tronçon Chinchaga consiste à construire un pipeline d’un diamètre extérieur de 1 219 mm (48 pouces) s’étendant sur environ 33 kilomètres, à environ 76 kilomètres au nord-ouest de Manning (Alberta), le long du doublement latéral no 3 actuel de Chinchaga, depuis la station de comptage de Chinchaga jusqu’à un point de raccordement à la station de compression actuelle de Meikle River;

Attendu que l’Office a tenu une audience publique à Fort Nelson (Colombie-Britannique) les 10 et 11 octobre 2012 et à Calgary (Alberta) du 15 au 24 octobre 2012;

Attendu que l’Office a examiné toute la preuve au dossier conformément aux exigences de la Loi sur l’Office national de l’énergie et ses responsabilités en vertu de la Loi sur l’Office national de l’énergie ayant trait aux questions environnementales et socio-économiques;

Attendu que l’Office estime que le programme de participation autochtone de NGTL était approprié compte tenu du cadre, de la nature et de l’envergure du projet et il est d’avis qu’on a fourni suffisamment de renseignements au sujet du projet à tous les groupes autochtones susceptibles d’être touchés par le projet et que ceux-ci ont eu la possibilité de faire connaître leurs points de vue à l’Office;

Attendu que l’Office a déterminé que, pourvu que soient mises en œuvre les méthodes de protection de l’environnement et les mesures d’atténuation de NGTL et que soient appliquées les exigences réglementaires et les conditions proposées par l’Office, le projet n’est pas susceptible d’entraîner des effets environnementaux négatifs importants;

Attendu que le certificat d’utilité publique GC-121 serait assorti d’une condition exigeant que NGTL dépose des rapports des consultations auprès des Autochtones pendant cinq ans afin d’informer l’Office de ses consultations en cours avec les groupes autochtones;

Attendu que l’Office, dans son rapport daté du 30 janvier 2013, remis au ministre des Ressources naturelles le 30 janvier 2013, a déterminé que les installations visées par l’article 52 pour le tronçon Chinchaga du projet seront requises pour l’utilité publique présente et future, et a recommandé qu’un certificat soit délivré pour le tronçon Chinchaga sous réserve des vingt-cinq conditions énoncées à l’annexe III de son rapport;

Attendu que l’Office a conclu que l’approbation du tronçon Komie Nord du projet, tel que proposé, aurait des conséquences commerciales négatives sur d’autres parties et que la nécessité de ce tronçon n'était pas certaine et a recommandé de ne pas délivrer de certificat pour le tronçon Komie Nord;

Attendu que l’Office a néanmoins établi les modalités contenues à l’annexe IV en rapport avec le tronçon Komie Nord du projet conformément à l’article 52 de la Loi sur l’Office national de l’énergie;

1) que toute répercussion défavorable possible sur les droits ancestraux ou issus de traités, potentiels ou établis, est susceptible d’être minime;

2) que, en cas de telles répercussions, le promoteur prendra les mesures appropriées, conformément aux conditions jointes au certificat;

Attendu que le présent dossier de la Couronne indique que celle-ci s’est bien acquittée de son obligation légale de consulter et d’accommoder, s’il y a lieu, en ce qui a trait au tronçon Chinchaga du projet;
