Whereas the Honourable C. Lynn Smith, a Judge of the Supreme Court of British Columbia, who has attained the age of fifty-five years, who has continued in judicial office for at least ten years and who has elected early retirement with an immediate annuity, has tendered her resignation effective September 7, 2012;

Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Justice,

(a) accepts the resignation of the Honourable C. Lynn Smith; and

(b) pursuant to subsection 43.1(1) of the Judges Act, grants the Honourable C. Lynn Smith an annuity of $181,823.11, commencing on September 7, 2012, and continuing during her life.

Attendu que l’honorable C. Lynn Smith, juge de la Cour suprême de la Colombie-Britannique, ayant atteint l’âge de cinquante-cinq ans, ayant au moins dix ans d’ancienneté dans la magistrature et ayant choisi une retraite anticipée avec une pension immédiate, a donné sa démission, laquelle prend effet le 7 septembre 2012,

À ces causes, sur recommandation du ministre de la Justice, Son Excellence le Gouverneur général en conseil :

a) accepte la démission de l’honorable C. Lynn Smith;

b) en vertu du paragraphe 43.1(1) de la Loi sur les juges, accorde à l’honorable C. Lynn Smith, à titre viager une pension annuelle de 181 823,11 $, payable à compter du 7 septembre 2012.
