Whereas the Minister of Transport is of the opinion that the interest in land described in the attached schedule is required by VIA Rail Canada Inc. for its railway;

Therefore, His Excellency the Governor General in Council, on recommendation of the Minister of Transport, pursuant to section 4.1 of the Expropriation Act, hereby consents that the Minister of Public Works and Government Services, on behalf of Her Majesty in right of Canada, have the interest in land situated in the City of Belleville, in the Province of Ontario, consisting of 0.64 acres of land owned by Shawn Milne and described in the attached schedule, expropriated in accordance with Part I of that Act.

À ces causes, sur recommandation du ministre des Transports et en vertu de l’article 4.1 de la Loi sur l’expropriation, Son Excellence le Gouverneur général en conseil donne son agrément au ministre des Travaux publics et des Services gouvernementaux, au nom de Sa Majesté du chef du Canada, pour qu’il fasse exproprier, en conformité avec la partie I de cette loi, le droit réel immobilier d’environ 0,64 acre de terrain situé dans la ville de Belleville en Ontario, appartenant à Shawn Milne et délimité à l’annexe ci-jointe.

All of those lands shown as Parts of Lot 26, Concession 1, Township of Thurlow, now in the City of Belleville, County of Hastings being more particularly described as Parts 1, 2 and 3 on Plan 21R-23352 received by and deposited at the Belleville Land Registry Office (Hastings No. 21) under the Land Titles Act of Ontario. Subject to an easement over Part 2 on Plan 21R-23352 in favour of The Hydro-Electric Power Commission of Ontario, as described in a certain indenture registered on the 17th day of May, 1933 in the Registry Office for the Registry Division of the County of Hastings, as instrument number THD8282.

The said Parts 1, 2 and 3 on Plan 21R-23352 containing an area of 2,593.8 m² (0.64 acres).

Toutes les terres constituant les parties du lot 26, concession 1, canton de Thurlow, à présent dans la ville de Belleville, comté de Hastings, plus particulièrement décrites comme étant les parties 1, 2 et 3 figurant sur le plan 21R-23352 déposé et reçu au bureau d’enregistrement immobilier de Belleville (Hastings n^o 21) en vertu de la Loi sur l’enregistrement des droits immobiliers de l’Ontario. Sous réserve d’une servitude sur la partie 2, indiquée sur le plan 21R-23352 en faveur de l’Hydro-Electric Power Commission of Ontario et figurant sous le numéro THD8282 dans un contrat bilatéral enregistré le 17 mai 1933 au bureau d’enregistrement de la circonscription foncière du comté de Hastings.

Les parties 1, 2 et 3 figurant sur le plan 21R-23352 ont une superficie totale de 2 593,8 m² (0,64 acre).
