(A) the Province shall transfer to Canada, at no cost, the administration and control of the Lands or any part of them, subject to no greater provisos and conditions than those contained in British Columbia Order in Council 1036 of July 29, 1938, as amended by British Columbia Order in Council 1555 of May 13, 1969, or as allowed in writing by Canada, and

(B) the Lands or any part of them that the Province is required to transfer to Canada in accordance with clause (A) shall be transferred by the Province in an environmentally sound condition, to be determined by the laws, regulations and policies of Canada then in force and may include the removal of all improvements, including any highways, and remediation of the Lands or any part of them to the satisfaction of Canada acting reasonably,

Attendu que la Province a demandé que lui soit transférée, aux fins autorisées, l’intégralité des droits que détient Sa Majesté du chef du Canada (le « Canada ») sur certaines terres faisant partie de la réserve indienne Stawamus no 24, mines et minéraux exclus, lesquelles sont délimitées à l’annexe (les « terres »), pour une route, au sens de la loi;

(iii)  dès lors que les terres cesseront, en tout ou en partie, d’être utilisées pour une route publique provinciale,

(A) la Province devra transférer au Canada, à titre gratuit, la gestion et la maîtrise de tout ou partie des terres, sous réserve des seules dispositions et conditions énoncées dans le décret en conseil de la Colombie-Britannique no 1036 du 29 juillet 1938, modifié par le décret en conseil de la Colombie-Britannique no 1555 du 13 mai 1969, ou en vertu d’une autorisation écrite du Canada;

(B) les terres rétrocédées en vertu de la division (A) devront être remises en bon état par la Province sur le plan environnemental, en conformité avec les textes fédéraux, lois, règlements et politiques en vigueur et à la satisfaction du Canada, agissant raisonnablement, ce qui pourrait nécessiter l’enlèvement de tous les ouvrages d’amélioration, notamment des ouvrages routiers, ainsi que la remise en état de tout ou partie des terres;

(iv) la Province devra verser au receveur général du Canada, à titre de contrepartie de la prise ou du transfert des terres, la somme de 1 308 500 $ à l’usage et au profit des Squamish, une bande au sens de la Loi sur les Indiens.
