                      Whereas Centra Gas British Columbia Inc. (the “Company”) is empowered by the Expropriation Act, R.S.B.C. 1996, c. 125, to take lands or an interest in lands without the consent of the owner for natural gas pipeline purposes;


                      And whereas the Company requires an easement on certain lands in Cowichan Indian Reserve No. 1, in the Province of British Columbia, described in the annexed schedule (the “Easement Area”) for the purposes of a natural gas pipeline easement;


                      Therefore, Her Excellency the Governor General in Council on the recommendation of the Minister of Indian Affairs and Northern Development, hereby:

 

(a) pursuant to subsection 35(1) of the Indian Act, consents to the exercise by the Company of the power to take an easement over the Easement Area without the consent of the owner, for natural gas pipeline purposes; and

 

(b) pursuant to subsection 35(3) of the Indian Act, in lieu of the Company taking an easement as in paragraph (a), authorizes the grant of an easement over the Easement Area to the Company for natural gas pipeline purposes, in accordance with the easement agreement set out in the annexed schedule.


                      Attendu qu’en vertu de la Expropriation Act, R.S.B.C. 1996, ch. 125, Centra Gas British Columbia Inc. (la « société ») a le pouvoir de prendre des terres ou tout droit sur celles-ci, sans le consentement du propriétaire, à des fins de pipeline de transmission de gaz naturel;


                      Attendu que la société a besoin d’une servitude sur certaines terres dans la réserve indienne Cowichan no 1, dans la province de la Colombie-Britannique, laquelle est décrite à l’annexe ci-jointe comme « Easement Area », à des fins de pipeline de transmission de gaz naturel,


                      À ces causes, sur recommandation du ministre des Affaires indiennes et du Nord canadien, Son Excellence la Gouverneure générale en conseil :

 

a) en vertu du paragraphe 35(1) de la Loi sur les Indiens, consent à ce que la société exerce son pouvoir de prendre, une servitude décrite dans l’annexe ci-jointe comme « Easement Area », sans le consentement du propriétaire, à des fins de pipeline de transmission de gaz naturel;

 

b) en vertu du paragraphe 35(3) de la Loi sur les Indiens, au lieu que la société prenne la servitude visée à l’alinéa a), autorise l’octroi de cette servitude à la société, conformément au « Easement Agreement » figurant à l’annexe ci-jointe, à des fins de pipeline de transmission de gaz naturel.
