Whereas, on January 24, 1961, the Osoyoos Band (the Band), a band within the meaning of the Indian Act, surrendered a part of the Osoyoos Indian Reserve No. 1, in the Province of British Columbia, for leasing purposes, which surrender was accepted by Order in Council P.C. 1961-237 of February 23, 1961 (the 1961 Surrender);

Whereas, on November 30, 1977, the Band assented to an amendment of the 1961 Surrender, which amendment was accepted by Order in Council P.C. 1978-425 of February 16, 1978;

Whereas the Band assented to the further amendment of the 1961 Surrender, as amended, on May 30, 2002, which further amendment was accepted by Order in Council P.C. 2002-1983 of November 21, 2002;

And whereas, a further amendment of the 1961 Surrender and a designation has been assented to by the Band;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 39(1)(c) and section 40 of the Indian Act, hereby accepts

(a) a further amendment of the 1961 Surrender, as amended, for leasing and other purposes, which amendment was assented to by the Osoyoos Band on November 18, 2009, and is set out in the attached schedule; and

(b) the designation made to Her Majesty in right of Canada by the Osoyoos Band of a portion of the Osoyoos Indian Reserve No. 1 for leasing and other purposes, which designation was assented to by the Osoyoos Band on November 18, 2009, and is set out in the attached schedule.

Attendu que, le 24 janvier 1961, la bande Osoyoos (la bande), une bande au sens de la Loi sur les Indiens, a cédé une partie de la réserve indienne Osoyoos nº 1, en Colombie-Britannique, à des fins de location, laquelle cession a été acceptée par le décret C.P. 1961-237 du 23 février 1961 (la cession de 1961);

Attendu que, le 30 novembre 1977, la bande a sanctionné une modification de la cession de 1961, laquelle modification a été acceptée par le décret C.P. 1978-425 du 16 février 1978;

Attendu que, le 30 mai 2002, la bande a sanctionné une nouvelle modification de la cession de 1961, laquelle modification a été acceptée par le décret C.P. 2002-1983 du 21 novembre 2002;

Attendu que la bande a sanctionné une autre modification de la cession de 1961 et la désignation faite à Sa Majesté du chef du Canada,

À ces causes, sur recommandation du ministre des Affaires indiennes et du Nord canadien et en vertu de l’alinéa 39(1)c) et de l’article 40 de la Loi sur les Indiens, Son Excellence la Gouverneure générale en conseil accepte :

a) la nouvelle modification de la cession de 1961, tel que modifiée, pour la location à bail et pour d’autres fins, laquelle modification ayant été sanctionnée par la bande Osoyoos le 18 novembre 2009 et figurant à l’annexe ci-jointe;

b) la désignation faite à Sa Majesté du chef du Canada par la bande Osoyoos d’une partie de la réserve indienne Osoyoos nº 1 pour la location à bail et pour d’autres fins, laquelle désignation ayant été sanctionnée par la bande Osoyoos le 18 novembre 2009 et figurant à l’annexe ci-jointe.
