Whereas the Honourable Nicholas W. Sherstobitoff, a Judge of the Court of Appeal for Saskatchewan, will attain the age of seventy-five years on September 28, 2010, and, therefore, will cease to hold office on that date under the provisions of subsection 99(2) of the Constitution Act, 1867;

And whereas the Honourable Nicholas W. Sherstobitoff has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants an annuity of $180,933.33 to the Honourable Nicholas W. Sherstobitoff, commencing on September 28, 2010, and continuing during his life.

Attendu que l’honorable Nicholas W. Sherstobitoff, juge de la Cour d’appel de la Saskatchewan, atteindra l’âge de soixante-quinze ans le 28 septembre 2010 et que, en conséquence, il cessera d’occuper son poste à cette date en vertu du paragraphe 99(2) de la Loi constitutionnelle de 1867;

Attendu que l’honorable Nicholas W. Sherstobitoff a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable Nicholas W. Sherstobitoff, à titre viager, une pension annuelle de 180 933,33 $, payable à compter du 28 septembre 2010.
