Whereas the Honourable Harvey Spiegel, a Judge of the Superior Court of Justice in and for the Province of Ontario, will attain the age of seventy-five years on March 25, 2010, and, therefore, will cease to hold office on that date under the provisions of subsection 99(2) of the Constitution Act, 1867;

And whereas the Honourable Harvey Spiegel has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants an annuity of $178,133.33 to the Honourable Harvey Spiegel, commencing on March 25, 2010, and continuing during his life.

Attendu que l’honorable Harvey Spiegel, juge de la Cour de justice de l’Ontario, atteindra l’âge de soixante-quinze ans le 25 mars 2010 et, en conséquence, cessera d’occuper son poste à cette date en application du paragraphe 99(2) de la Loi constitutionnelle de 1867;

Attendu que l’honorable Harvey Spiegel a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable Harvey Spiegel, à titre viager, une pension annuelle de 178 133,33 $, payable à compter du 25 mars 2010.
