Whereas the Honourable Allen M. Linden, a Judge of the Federal Court of Appeal, will attain the age of seventy-five years on October 7, 2009, and, therefore, will cease to hold office on that date under the provisions of subsection 99(2) of the Constitution Act, 1867;

And whereas the Honourable Allen M. Linden has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants an annuity of $178,133.33 to the Honourable Allen M. Linden, commencing on October 7, 2009, and continuing during his life.

Attendu que l’honorable Allen M. Linden, juge de la Cour d’appel fédérale, atteindra l’âge de soixante-quinze ans le 7 octobre 2009 et, en conséquence, cessera d’occuper son poste à cette date en application du paragraphe 99(2) de la Loi constitutionnelle de 1867;

Attendu que l’honorable Allen M. Linden a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable Allen M. Linden, à titre viager, une pension annuelle de 178 133,33 $, à compter du 7 octobre 2009.
