Whereas the Honourable John D. Richard, Chief Justice of the Federal Court of Appeal, will attain the age of seventy-five years on July 30, 2009, and, therefore, will cease to hold office on that date under the provisions of subsection 99(2) of the Constitution Act, 1867;

And whereas the Honourable John D. Richard has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants an annuity of $195,266.66 to the Honourable John D. Richard, commencing on July 30, 2009 and continuing during his life.

Attendu que l’honorable John D. Richard, juge en chef de la Cour d’appel fédérale, atteindra l’âge de soixante-quinze ans le 30 juillet 2009 et, en conséquence, cessera d’occuper son poste à cette date en vertu du paragraphe 99(2) de la Loi constitutionnelle de 1867;

Attendu que l’honorable John D. Richard a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable John D. Richard, à titre viager, une pension annuelle de 195 266,66 $, payable à compter du 30 juillet 2009.
