Whereas the Honourable Rose T. Boyko, a Judge

of the Superior Court of Justice in and for the Province of Ontario, who has attained the age of fifty-five years, who has continued in judicial office for at least ten years and who has elected early retirement with an immediate annuity, has tendered her resignation effective November 29, 2008;

Therefore, Her Excellency the Governor General

in Council, on the recommendation of the Minister of Justice, hereby:

(a) accepts the resignation of the Honourable Rose T. Boyko;

and

(b) pursuant to subsection 43.1(1) of the Judges Act,

hereby grants her an annuity of $134,680, commencing on November 29, 2008 and continuing during her life.

Attendu que l'honorable Rose T. Boyko, juge de la Cour supérieure de justice de l’Ontario, ayant atteint l’âge de cinquante-cinq ans, ayant au moins dix ans d’ancienneté dans la magistrature et ayant choisi une retraite anticipée avec une pension immédiate, a donné sa démission, laquelle prend effet le 29 novembre 2008,

À ces causes, sur recommandation du ministre de la Justice, Son Excellence la Gouverneure générale en conseil :

a) accepte la démission de l'honorable Rose T. Boyko;

b) en vertu du paragraphe 43.1(1) de la Loi sur les juges, lui accorde, à titre viager, une pension annuelle de 134 680 $, payable à compter du 29 novembre 2008.
