Whereas the Honourable Robert J. Higgins,

a Judge of the Court of Queen’s Bench of New Brunswick,

Trial Division, will attain the age of seventy-five years

on January 13, 2009, and, therefore, will cease to hold office

on that date under the provisions of section 99 of the Constitution Act, 1867;

And whereas the Honourable Robert J. Higgins has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General

in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants

an annuity of $173,333.33 to the Honourable Robert J. Higgins, commencing on January 13, 2009 and continuing during his life.

Attendu que l'honorable Robert J. Higgins,

juge de la Cour du Banc de la Reine du Nouveau-Brunswick,

Division de première instance, atteindra l'âge de soixante-quinze ans le 13 janvier 2009 et, en conséquence, cessera d'occuper son poste

à cette date en vertu de l'article 99 de la Loi constitutionnelle de 1867;

Attendu que l’honorable Robert J. Higgins a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de

la Justice et en vertu de l'alinéa 42(1)d) de la Loi sur les juges,

Son Excellence la Gouverneure générale en conseil accorde à l'honorable Robert J. Higgins, à titre viager, une pension annuelle

de 173 333,33 $, payable à compter du 13 janvier 2009.
