                        Whereas the Laurentian Pilotage Authority, pursuant to subsection 20(3) of the Pilotage Act, published in the Canada Gazette, Part I, on March 3, 2007, a copy of the proposed Regulations Amending the Laurentian Pilotage Authority Regulations, substantially in the form set out in the annexed Regulations;

 

Whereas the proposed Regulations were published pursuant to subsection 20(3) of the Pilotage Act because the Authority proposed to make certain portions of the proposed Regulations under paragraph 20(1)(f) of that Act;

 

Whereas notices of objection to the proposed Regulations setting out the grounds therefor were filed with the Minister of Transport, Infrastructure and Communities, pursuant to subsection 21(1) of the Pilotage Act;

 

Whereas an investigation was made of the proposed Regulations, including consultations with interested parties, and the report of the investigator was sent to the Minister of Transport, Infrastructure and Communities recommending that the Minister amend the proposed Regulations;

 

Whereas the Minister of Transport, Infrastructure and Communities, pursuant to subsection 21(4) of the Pilotage Act, may, by order, approve, amend or disapprove those portions of the proposed Regulations in respect of which a notice of objection was filed pursuant to subsection 21(1) of that Act;

 

Whereas the Minister of Transport, Infrastructure and Communities, pursuant to subsection 21(4) of the Pilotage Act, made an order on November 5, 2007 amending the proposed Regulations;

 

Whereas the Order Amending the Proposed Regulations Amending the Laurentian Pilotage Authority Regulations was published in the Canada Gazette, Part II, on November 28, 2007;

 

And whereas the Laurentian Pilotage Authority made on December 12, 2007, the annexed Regulations Amending the Laurentian Pilotage Authority Regulations, in accordance with subsection 21(4) of the Pilotage Act;


 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, Infrastructure and Communities, pursuant to subsection 20(1) of the Pilotage Act, hereby approves the annexed Regulations Amending the Laurentian Pilotage Authority Regulations, made on December 12, 2007, by the Laurentian Pilotage Authority.


 

                        Attendu que, conformément au paragraphe 20(3) de la Loi sur le pilotage, l’Administration de pilotage des Laurentides a publié dans la Gazette du Canada Partie I, le 3 mars 2007, le projet de règlement intitulé Règlement modifiant le Règlement de l’Administration de pilotage des Laurentides, conforme en substance au texte ci‑après;

 

Attendu que le projet de règlement a été publié conformément au paragraphe 20(3) de la Loi sur le pilotage parce que l’Administration se propose de prendre certaines parties de celui‑ci en vertu de l’alinéa 20(1)f) de cette loi;

 

Attendu que des avis d’opposition motivés à l’égard du projet de règlement ont été déposés auprès du ministre des Transports, de l’Infrastructure et des Collectivités conformément au paragraphe 21(1) de la Loi sur le pilotage;

 

Attendu qu’une enquête a été effectuée relativement au projet de règlement, y compris la tenue de consultations avec les intéressés, et que l’enquêteur a remis au ministre des Transports, de l’Infrastructure et des Collectivités un rapport recommandant que ce dernier modifie le projet de règlement;

 

Attendu que le ministre des Transports, de l’Infrastructure et des Collectivités peut, par arrêté, en vertu du paragraphe 21(4) de la Loi sur le pilotage, approuver, modifier ou rejeter les parties du projet de règlement à l’égard desquelles un avis d’opposition motivé a été déposé conformément au paragraphe 21(1) de cette loi;

 

Attendu que le ministre des Transports, de l’Infrastructure et des Collectivités a pris un arrêté, en vertu du paragraphe 21(4) de la Loi sur le pilotage, le 5 novembre 2007, modifiant le projet de règlement;

 

Attendu que l’Arrêté modifiant le projet de Règlement modifiant le Règlement de l’Administration de pilotage des Laurentides a été publié dans la Gazette du Canada Partie II, le 28 novembre 2007;

 

Attendu que l’Administration de pilotage des Laurentides a pris, le 12 décembre 2007, le règlement intitulé Règlement modifiant le Règlement de l’Administration de pilotage des Laurentides, conformément au paragraphe 21(4) de la Loi sur le pilotage,


À ces causes, sur recommandation du ministre des Transports, de l’Infrastructure et des Collectivités et en vertu du paragraphe 20(1) de la Loi sur le pilotage, Son Excellence la Gouverneure générale en conseil approuve le Règlement modifiant le Règlement de l’Administration de pilotage des Laurentides, ci‑après, pris le 12 décembre 2007 par l’Administration de pilotage des Laurentides.
