Whereas the Honourable J. Brian D. Malone, a Judge of the Federal Court of Appeal, has become afflicted with a permanent infirmity disabling him from the due execution of his office and has tendered his resignation;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, hereby:

 

(a) accepts the resignation of the Honourable J. Brian D. Malone; and

(b) pursuant to paragraph 42(1)(c) of the Judges Act, grants to

the Honourable J. Brian D. Malone an annuity of $168,000 to

commence on the date of this Order in Council and to continue during his life.

Attendu que l’honorable J. Brian D. Malone, juge de la Cour d’appel fédérale, a donné sa démission pour incapacité par suite d’une infirmité permanente,

 

À ces causes, sur recommandation du ministre de Justice, Son Excellence la Gouverneure générale en conseil :

 

a) accepte la démission de l’honorable J. Brian D. Malone;

b) en vertu de l’alinéa 42(1)c) de la Loi sur les juges, accorde à l’honorable J. Brian D. malone, à titre viager, une pension annuelle de 168 000 $, payable à compter de la date du présent décret.
