Whereas subsection 108(3) of the Corrections and Conditional Release Act provides that subsection 108(2) of that Act does not apply in a province until a day fixed by order of the Governor in Council made after the enactment of a provincial Act authorizing the National Parole Board to exercise the jurisdiction referred to in that subsection;

 

And whereas on March 29, 2007, the Province of British Columbia enacted the Miscellaneous Statutes Amendment Act, 2007, S.B.C. 2007, c. 8, which authorizes the National Parole Board to exercise in that Province the jurisdiction referred to in subsection 108(2) of the Corrections and Conditional Release Act;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Public Safety and Emergency Preparedness, pursuant to subsection 108(3) of the Corrections and Conditional Release Act, hereby fixes April 19, 2007 as the day on which subsection 108(2) of that Act applies in the Province of British Columbia.

Attendu que le paragraphe 108(3) de la Loi sur le système correctionnel et la mise en liberté sous condition prévoit que le paragraphe 108(2) de cette loi ne s’applique dans toute province qu’à la date fixée par décret du gouverneur en conseil pris après l’adoption d’une loi provinciale autorisant la Commission nationale des libérations conditionnelles à exercer la compétence que lui confère ce paragraphe;

 

Attendu que la province de la Colombie-Britannique, le 29 mars 2007, a adopté la loi intitulée Miscellaneous Statutes Amendment Act, 2007, S.B.C. 2007, ch. 8, laquelle autorise la Commission nationale des libérations conditionnelles à exercer dans la province la compétence visée par le paragraphe 108(2) de la Loi sur le système correctionnel et la mise en liberté sous condition,

 

À ces causes, sur recommandation du ministre de la Sécurité publique et de la Protection civile et en vertu du paragraphe 108(3) de la Loi sur le système correctionnel et la mise en liberté sous condition, Son Excellence la Gouverneure générale en conseil fixe au 19 avril 2007 la date à compter de laquelle le paragraphe 108(2) de cette loi s’applique dans la province de la Colombie-Britannique.
