Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to subsections 27(1.1) and (1.2) of the Species at Risk Act (“the Act”), hereby
(a) decides not to add the Newfoundland and Labrador population, the Laurentian North population, the Maritimes population of Atlantic Cod (Gadus morhua) and the Interior Fraser population of Coho Salmon (Oncorhynchus kisutch) to the List of Wildlife Species at Risk (“the List”) set out in Schedule 1 to the Act;
(b) refers the assessment for Lake Winnipeg Physa (Physa sp.), Bocaccio (Sebastes paucispinis), Shortjaw Cisco (Coregonus zenithicus), Cusk (Brosme brosme), the Northwest Atlantic population of the Harbour Porpoise (Phocoena phocoena) and the Arctic population of Atlantic Cod (Gadus morhua) back to the Committee on the Status of Endangered Wildlife in Canada (COSEWIC) for further information and consideration;
(c) approves that the Minister of the Environment include the statement attached as Annex 1 to this Order in the public registry (“the public registry”) established under section 120 of the Act setting out the reasons for not adding the Newfoundland and Labrador population, the Laurentian North population, the Maritimes population of Atlantic Cod (Gadus morhua) and the Interior Fraser population of Coho Salmon (Oncorhynchus kisutch) to the List; and
(d) approves that the Minister of the Environment include the statement attached as Annex 2 to this Order in the public registry setting out the reasons for referring the assessment for Lake Winnipeg Physa (Physa sp.), Bocaccio (Sebastes paucispinis), Shortjaw Cisco (Coregonus zenithicus), Cusk (Brosme brosme), the Northwest Atlantic population of the Harbour Porpoise (Phocoena phocoena) and the Arctic population of Atlantic Cod (Gadus morhua) back to COSEWIC for further information and consideration.
Sur recommandation de la ministre de l’Environnement et en vertu des paragraphes 27(1.1) et (1.2) de la Loi sur les espèces en péril (ci‑après la « Loi »), Son Excellence la Gouverneure générale en conseil :
a) décide de ne pas ajouter la population de Terre-Neuve‑et-Labrador, la population du nord laurentien et la population des Maritimes de la morue franche de l’Atlantique (Gadus morhua) ainsi que la population du Fraser intérieur du saumon coho (Oncorhynchus kisutch) à la Liste des espèces en péril (ci‑après la « Liste ») figurant à l’annexe 1 de la Loi;
b) renvoie l’évaluation de la physe du lac Winnipeg (Physa sp.), du bocaccio (Sébastes paucispinis), du cisco à mâchoires égales (Coregonus zenithicus), du brosme (Brosme brosme), de la population de l’Atlantique Nord-Ouest du marsouin commun (Phocoena phocoena) et de la population de l’Arctique de la morue franche de l’Atlantique (Gadus morhua) au Comité sur la situation des espèces en péril au Canada (COSEPAC) pour obtenir des renseignements supplémentaires et pour réexamen;
c) agrée que la ministre de l’Environnement verse au registre, établi en vertu de l’article 120 de la Loi, la déclaration qui figure à l’annexe 1 du décret et qui énonce les motifs de la décision de ne pas ajouter à la Liste la population de Terre-Neuve‑et-Labrador, la population du nord laurentien et la population des Maritimes de la morue franche de l’Atlantique (Gadus morhua) ainsi que la population du Fraser intérieur du saumon coho (Oncorhynchus kisutch);
d) agrée que la ministre de l’Environnement verse au registre la déclaration qui figure à l’annexe 2 du présent décret, qui énonce les motifs de la décision de renvoyer l’évaluation de la physe du lac Winnipeg (Physa sp.), du bocaccio (Sébastes paucispinis), du cisco à mâchoires égales (Coregonus zenithicus), du brosme (Brosme brosme), de la population de l’Atlantique Nord-Ouest du marsouin commun (Phocoena phocoena) et de la population de l’Arctique de la morue franche de l’Atlantique (Gadus morhua) au COSEPAC pour obtenir des renseignements supplémentaires et pour réexamen.
