Whereas the Honourable Allan McNiece Austin, a Judge of the Court of Appeal for Ontario, will attain the age of seventy-five years on March 7, 2003, and, therefore, will cease to hold office on that date under the provisions of section 99 of the Constitution Act, 1867;

And whereas Mr. Justice Austin has held judicial office for at least ten years;

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Justice, pursuant to paragraph 42(1)(d) of the Judges Act, hereby grants an annuity of $140,133.33 to the Honourable Allan McNiece Austin, commencing on March 7, 2003, and continuing thenceforth during his life.

Attendu que l’honorable Allan McNiece Austin, juge de la Cour d’appel de l’Ontario, atteindra l’âge de soixante-quinze ans le 7 mars 2003 et, en conséquence, cessera d’occuper son poste à cette date en vertu de l’article 99 de la Loi constitutionnelle de 1867;

Attendu que le juge Austin a exercé des fonctions judiciaires pendant au moins dix ans,

À ces causes, sur recommandation du ministre de la Justice et en vertu de l’alinéa 42(1)d) de la Loi sur les juges, Son Excellence la Gouverneure générale en conseil accorde à l’honorable Allan McNiece Austin, à titre viager, une pension annuelle de 140 133,33 $, payable à compter du 7 mars 2003.
