                     Her Excellency the Governor General in Council, on the recommendation of the Minister of the Environment, pursuant to paragraphs 27(1.1)(b) and (c) and subsection 27(1.2) of the Species at Risk Act (the Act), hereby

(a) decides not to add the Porsild's bryum (Mielichhoferia macrocarpa), the plains bison (Bison bison bison), the Peary caribou (Rangifer tarandus pearyi) and the Dolphin and Union population of the barren-ground caribou (Rangifer tarandus groenlandicus) to the List of Wildlife Species at Risk (the List) set out in Schedule 1 to the Act;

(b) acknowledges receipt of the assessment of the status of the polar bear (Ursus maritimus) done pursuant to subsection 23(1) of the Act by the Committee on the Status of Endangered Wildlife in Canada (COSEWIC);

(c) refers the assessment for the polar bear (Ursus maritimus) referred to in paragraph (b) and the dwarf woolly-heads (Psilocarphus brevissimus) referred to in Order in Council P.C. 2004-1175 of October 19, 2004 back to COSEWIC for further information and consideration; and

(d) approves that the Minister of the Environment include a statement in the public registry established under section 120 of the Act

(i) in the form attached as Annex 1 to this Order setting out the reasons for deciding not to add the plains bison (Bison bison bison) to the List,

(ii) in the form attached as Annex 2 to this Order setting out the reasons for deciding not to add the Porsild's bryum (Mielichhoferia macrocarpa), the Peary caribou (Rangifer tarandus pearyi) and the Dolphin and Union population of the barren-ground caribou (Rangifer tarandus groenlandicus) to the List, and

(ii) in the form attached as Annex 3 to this Order setting out the reasons for referring the assessment for the polar bear (Ursus maritimus) and the dwarf woolly-heads (Psilocarphus brevissimus) back to COSEWIC for further information and consideration.

                     Sur recommandation du ministre de l’Environnement et en vertu des alinéas 27(1.1)b) et c) et du paragraphe 27(1.2) de la Loi sur les espèces en péril (la « Loi »), Son Excellence la Gouverneure générale en conseil :

a) décide de ne pas inscrire le bryum de Porsild (Mielichhoferia macrocarpa), le bison des prairies (Bison bison bison), le caribou de Peary (Rangifer tarandus pearyi) et la population Dolphin-et-Union du caribou de la toundra (Rangifer tarandus groenlandicus) sur la Liste des espèces en péril figurant à l'annexe 1 de la Loi (la « liste ») ;

b) accuse réception de l'évaluation de la situation de l'ours blanc (Ursus maritimus) faite conformément au paragraphe 23(1) de la Loi par le Comité sur la situation des espèces en péril au Canada (COSEPAC);

c) renvoie au COSEPAC l'évaluation de la situation de l'ours blanc (Ursus maritimus) visé à l’alinéa b) et du psilocarphe nain (Psilocarphus brevissimus) visé dans le décret C.P. 2004-1175 du 19 octobre 2004, pour obtention de renseignements supplémentaires et pour réexamen;

d) agrée que le ministre de l'Environnement mette dans le registre public établi en vertu de l'article 120 de la Loi :

(i) la déclaration qui figure à l’annexe 1 ci-jointe et qui énonce les motifs de la décision de ne pas inscrire sur la liste le bison des prairies (Bison bison bison),

(ii) la déclaration qui figure à l’annexe 2 ci-jointe et qui énonce les motifs de la décision de ne pas inscrire sur la liste le bryum de Porsild (Mielichhoferia macrocarpa), le caribou de Peary (Rangifer tarandus pearyi) et la population Dolphin-et-Union du caribou de la toundra (Rangifer tarandus groenlandicus),

(iii) la déclaration qui figure à l’annexe 3 ci-jointe et qui énonce les motifs du renvoi au COSEPAC de l’évaluation de la situation du psilocarphe nain (Psilocarphus brevissimus) et de l’ours blanc (Ursus maritimus), pour obtention de renseignements supplémentaires et pour réexamen.
