                        Whereas on February 4, 2005, the Batchewana First Nation Band, in the Province of Ontario, held an election for a chief and eight councillors, the summary of which is set out in the annexed schedule;

                     Whereas the Minister of Indian Affairs and Northern Development has reported that it has been established that the ballots for chief were tallied incorrectly by the electoral officer, resulting in a violation of subsection 8(1) of the Indian Band Election Regulations;

                     And whereas, in accordance with paragraph 14(b) of the Indian Band Election Regulations, the Minister of Indian Affairs and Northern Development has reported that he is satisfied that the tallying error constituted a violation of those Regulations and affected the result of the election for chief;

                     Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Indian Affairs and Northern Development, pursuant to paragraph 79(b) of the Indian Act, hereby sets aside the election, on February 4, 2005, of Vernon Syrette as Chief of the Batchewana First Nation Band, in the Province of Ontario.

                     Attendu que, le 4 février 2005, la bande indienne Batchewana First Nation, dans la province d’Ontario, a tenu une élection pour le poste de chef et huit postes de conseiller, le sommaire de l’élection figurant à l’annexe ci-jointe;

                     Attendu que le ministre des Affaires indiennes et du Nord canadien a indiqué dans son rapport que les bulletins de vote pour le poste de chef ont été comptabilisés de façon erronée par le président d’élection, faisant en sorte qu’il y a eu violation du paragraphe 8(1) du Règlement sur les élections au sein des bandes d’Indiens;

                     Attendu que, en vertu de l’alinéa 14b) du Règlement sur les élections au sein des bandes d’Indiens, le ministre des Affaires indiennes et du Nord canadien a également indiqué que cette erreur constitue une violation de ce règlement et a influé sur le résultat de l’élection pour le poste de chef,

                     À ces causes, sur recommandation du ministre des Affaires indiennes et du Nord canadien et en vertu de l’alinéa 79b) de la Loi sur les Indiens, Son Excellence la Gouverneure générale en conseil annule l’élection, le 4 février 2005, de Vernon Syrette à titre de chef de la bande indienne Batchewana First Nation, dans la province d’Ontario.
