                     Whereas, pursuant to subsection 34(1) of the Pilotage Act, the Laurentian Pilotage Authority published the proposed Regulations Amending the Laurentian Pilotage Tariff Regulations in the Canada Gazette, Part I, on July 31, 2004;

                     Whereas two notices of objection to the proposed Regulations were filed with the Canadian Transportation Agency in accordance with subsection 34(2) of the Pilotage Act and the Agency made an investigation of the proposed charges in order to make its recommendation to the Laurentian Pilotage Authority pursuant to subsection 35(1) of that Act;

                     Whereas, under subsection 34(1) of the Pilotage Act, the Laurentian Pilotage Authority made, after the expiration of thirty days after the date of publication in the Canada Gazette, Part I, the Regulations Amending the Laurentian Pilotage Tariff Regulations, registered under number SOR/2004-313;

                     And whereas the Canadian Transportation Agency, in Decision No. 709-W-2004, dated December 29, 2004, determined in part that the new docking fee at St. Lambert Lock set out in section 2 of SOR/2004-313 is prejudicial to the public interest and may not be implemented;

                     Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to subsections 33(1) and 35(5) of the Pilotage Act, hereby approves the annexed Regulations Amending the Laurentian Pilotage Tariff Regulations, made on February 2, 2005 by the Laurentian Pilotage Authority.

                     Attendu que, conformément au paragraphe 34(1) de la Loi sur le pilotage, l’Administration de pilotage des Laurentides a publié dans la Gazette du Canada Partie I, le 31 juillet 2004, le projet de règlement intitulé Règlement modifiant le Règlement sur les tarifs de pilotage des Laurentides;

                     Attendu que deux avis d’opposition au projet de règlement ont été déposés auprès de l’Office des transports du Canada en vertu du paragraphe 34(2) de la Loi sur le pilotage et que celui-ci a fait une enquête sur les droits proposés afin de faire une recommandation à l’Administration de pilotage des Laurentides conformément au paragraphe 35(1) de cette loi;

                     Attendu que, conformément au paragraphe 34(1) de la Loi sur le pilotage, l’Administration de pilotage des Laurentides a pris, après l’expiration d’un délai de trente jours à partir de la date de publication dans la Gazette du Canada Partie I, le Règlement modifiant le Règlement sur les tarifs de pilotage des Laurentides, enregistré sous le numéro DORS/2004-313;

                     Attendu que, dans sa décision no 709-W-2004 datée du 29 décembre 2004, l’Office des transports du Canada a conclu en partie que le nouveau droit d’accostage à l’écluse de Saint-Lambert figurant à l’article 2 du texte DORS/2004-313 est préjudiciable à l’intérêt public et ne peut être mis en oeuvre,

                     À ces causes, sur recommandation du ministre des Transports et en vertu des paragraphes 33(1) et 35(5) de la Loi sur le pilotage, Son Excellence la Gouverneure générale en conseil approuve le Règlement modifiant le Règlement sur les tarifs de pilotage des Laurentides, ci-après, pris le 2 février 2005 par l’Administration de pilotage des Laurentides.
