Whereas, on February 16, 2018, the Canadian Transportation Agency (Agency) issued Determination No. R-2018-23, finding that the City of Ottawa (City) had effectively discontinued the operation of a portion of its Ottawa River Line (ORL) without complying with the mandatory discontinuance process set out in the Canada Transportation Act (Act);

 

Whereas the Agency ordered the City to either take the steps necessary to restore the ORL, including the Prince of Wales Bridge, to a point where it could be made operable within 12 months of an Agency order made under Division IV of Part III of the Act, or initiate and complete the discontinuance process established in Division V of Part III of the Act;

 

Whereas section 40 of the Act provides that the Governor in Council may, at any time, either on petition of an interested person, or on its own motion, vary or rescind any decision of the Agency;

 

Whereas the Act does not impose on railway companies an obligation to maintain a railway line in an operational or near operational state in a context where there is no demand for service;

 

Whereas the Agency’s Determination could, contrary to the national transportation policy set out in article 5 of the Act, impose on a railway company an obligation to invest in an unused and non-profitable railway line, encourage a railway company to follow the process set out in Division V of Part III of the Act in order to end its obligations in respect of an unused or non-profitable line sooner than it otherwise would have done, and discourage a railway company from buying available railway lines for future operation;

Whereas, for these reasons, the Governor in Council is of the opinion that the Agency’s Determination must be rescinded;

 

Whereas, on September 18, 2018, Moose Consortium petitioned the Governor in Council, pursuant to section 40 of the Act, to vary the Agency’s Determination;

 

Therefore, Her Excellency the Governor General in Council, on the recommendation of the Minister of Transport, pursuant to section 40 of the Canada Transportation Act, rescinds on its own motion Determination No. R-2018-23 of February 16, 2018, of the Canadian Transportation Agency and consequently dismisses the petition of Moose Consortium.

 

 


Attendu que, le 16 février 2018, l’Office des transports du Canada (Office) a rendu la décision no R-2018-23, dans laquelle il conclut que la Ville d’Ottawa (Ville) a effectivement cessé l’exploitation d’un tronçon de sa ligne de la rivière des Outaouais (LRO) sans se conformer au processus obligatoire de cessation d’exploitation prévu par la Loi sur les transports au Canada (Loi);

 

Attendu que l’Office a ordonné à la Ville de prendre les mesures nécessaires pour remettre en état la LRO, y compris le pont Prince-de-Galles, de manière à ce qu’elle puisse être remise en service dans les douze mois suivant un arrêté de l’Office pris en vertu de la section IV de la partie III de la Loi, ou de mener à bien le processus de cessation d’exploitation prévu à la section V de la partie III de la Loi;

 

Attendu que l’article 40 de la Loi prévoit que le gouverneur en conseil peut, de sa propre initiative ou à la demande d’un intéressé, modifier ou annuler toute décision de l’Office;

 

Attendu que la Loi n’impose pas aux compagnies de chemin de fer l’obligation de maintenir une ligne en état d’exploitation ou dans un état proche de celui-ci dans un contexte où il n’y a pas de demande de service;

 

Attendu que la décision de l’Office pourrait avoir pour effet, contrairement à la politique nationale des transports prévue à l’article 5 de la Loi, d’obliger une compagnie de chemin de fer à investir dans une ligne inutilisée ou non rentable, d’encourager une compagnie de chemin de fer à suivre le processus établi à la section V de la partie III de la Loi pour mettre fin à ses obligations à l’égard d’une ligne inutilisée ou non rentable plus tôt qu’elle ne le ferait autrement et de décourager une compagnie de chemin de fer d’acheter une ligne à des fins d’exploitation future;

Attendu que, pour ces motifs, la gouverneure en conseil est d’avis que la décision de l’Office doit être annulée;

 

Attendu que, le 18 septembre 2018, le Consortium Moose a présenté une requête à la gouverneure en conseil en vertu de l’article 40 de la Loi pour faire modifier la décision de l’Office,

 

À ces causes, sur recommandation du ministre des Transports et en vertu de l’article 40 de la Loi sur les transports au Canada, Son Excellence la Gouverneure générale en conseil annule de sa propre initiative la décision no R-2018-23 du 16 février 2018 de l’Office des transports du Canada et, en conséquence, rejette la requête du Consortium Moose.
