Whereas, on March 31, 2015, NOVA Gas Transmission Ltd. (NGTL) applied to the National Energy Board (Board) pursuant to Part III of the National Energy Board Act for a certificate of public convenience and necessity in respect of the proposed construction and operation of the 2017 NGTL System Expansion Project (Project);
Whereas, on June 1, 2016, having reviewed NGTL’s application and conducted an environmental assessment of the Project, the Board submitted its report on the Project entitled NOVA Gas Transmission Ltd. GH-002-2015 (Board’s Report) to the Minister of Natural Resources pursuant to section 29 of the Canadian Environmental Assessment Act, 2012 and section 52 of the National Energy Board Act;
Whereas, by Order in Council P.C. 2016-578 of June 17, 2016, the Governor in Council, pursuant to subsection 54(3) of the National Energy Board Act, extended the time limit referred to in that subsection by two months to allow for additional Crown consultation with potentially affected Aboriginal groups and the general public;
Whereas the Governor in Council, having considered Aboriginal concerns and interests identified in the Crown Consultation and Accommodation Report, is satisfied that the consultation process undertaken is consistent with the honour of the Crown and that the concerns and interests have been appropriately accommodated;
Whereas the Governor in Council accepts the Board’s recommendation that the Project will be, if the terms and conditions set out in Appendix III of the Board’s Report are complied with, required by the present and future public convenience and necessity and will not likely cause significant adverse environmental effects;

And whereas the Governor in Council considers that the Project would enhance natural gas transmission infrastructure for adequate gas supply and support environmentally sustainable resource development;
Therefore, His Excellency the Governor General in Council, on the recommendation of the Minister of Natural Resources,
(a) pursuant to subsection 31(1) of the Canadian Environmental Assessment Act, 2012, decides that, taking into account the terms and conditions referred to in paragraph (b), the 2017 NGTL System Expansion Project is not likely to cause significant adverse environmental effects, and directs the National Energy Board to issue a decision statement concerning the Project; and
(b) pursuant to subsection 54(1) of the National Energy Board Act, directs the National Energy Board to issue Certificate of Public Convenience and Necessity GC-126 to NOVA Gas Transmission Ltd., in respect of the proposed construction and operation of the 2017 NGTL System Expansion Project, subject to the terms and conditions set out in Appendix III of the National Energy Board Report of June 2016 entitled NOVA Gas Transmission Ltd. GH-002-2015.
Attendu que, le 31 mars 2015, NOVA Gas Transmission Ltd. (NGTL) a présenté à l’Office national de l’énergie (Office), sous le régime de la partie III de la Loi sur l’Office national de l’énergie, une demande visant l’obtention d’un certificat d’utilité publique concernant la construction et l’exploitation du projet d’agrandissement du réseau de NGTL en 2017 (projet);
Attendu que, le 1er juin 2016, après avoir examiné la demande de NGTL et effectué l’évaluation environnementale du projet, l’Office a présenté au ministre des Ressources naturelles son rapport sur le projet intitulé NOVA Gas Transmission Ltd. GH-002-2015 (le rapport de l’Office), conformément à l’article 29 de la Loi canadienne sur l’évaluation environnementale (2012) et à l’article 52 de la Loi sur l’Office national de l’énergie;
Attendu que le gouverneur en conseil, en vertu du paragraphe 54(3) de la Loi sur l’Office national de l’énergie, a prorogé de deux mois le délai visé à ce paragraphe afin de permettre des consultations supplémentaires de la Couronne auprès du public et des groupes autochtones potentiellement affectés, par le décret C.P. 2016-578 du 17 juin 2016;
Attendu que le gouverneur en conseil est convaincu, après examen des préoccupations et des intérêts des groupes autochtones identifiés dans le Rapport sur la consultation et l’accommodement de la Couronne, daté du 14 octobre 2016, sur la consultation et l’accommodement de la Couronne, que le processus de consultation est compatible avec l’honneur de la Couronne et que les préoccupations et intérêts ont fait l’objet de mesures d’accommodement appropriées;

Attendu que le gouverneur en conseil accepte la recommandation de l’Office selon laquelle, si les conditions énoncées à l’annexe III du rapport de l’Office sont respectées, le projet présentera un caractère d’utilité publique, tant pour le présent que pour le futur, et qu’il n’est pas susceptible d’entraîner des effets environnementaux négatifs importants;
Attendu que le gouverneur en conseil considère que le projet renforcerait l’infrastructure de transport du gaz naturel pour un approvisionnement en gaz naturel adéquat et faciliterait, au plan environnemental, l’exploitation durable des ressources,
À ces causes, sur recommandation du ministre des Ressources naturelles, Son Excellence le Gouverneur général en conseil :
a) en vertu du paragraphe 31(1) de la Loi canadienne sur l’évaluation environnementale (2012), décide, compte tenu des conditions visées à l’alinéa b), que la réalisation du projet d’agrandissement du réseau de NGTL en 2017 n’est pas susceptible d’entraîner des effets environnementaux négatifs importants et donne instruction à l’Office national de l’énergie de faire une déclaration visant le projet;
b) en vertu du paragraphe 54(1) de la Loi sur l’Office national de l’énergie, donne à l’Office national de l’énergie instruction de délivrer à NGTL le certificat d’utilité publique GC-126 à l’égard du projet de construction et d’exploitation du projet d’agrandissement du réseau de NGTL en 2017 et d’assortir le certificat des conditions figurant à l’annexe III du rapport de l’Office national de l’énergie intitulé NOVA Gas Transmission Ltd. GH-002-2015 de juin 2016.
